From the FAQ:<br />"Note, that non-winning problems in mixed mode may include positions where the material is currently close to even (up to around a pawn down), but the position is lost in the long term. Here the best move will be the move which gives the best chances of holding a draw in a theoretically lost position."<br /><br />So unless other moves do a better job of trying to hold on than Be3, then the problem is still deemed to be valid. If I take on e6 first, then I force the White king to f1 and in the later lines, White will have the e1-square available for the rook. <br /><br />Furthermore, after 1...Nxf3+ 2.Qxf3 Qxe7, when White starts the "perpetual check", Black will at some point be able to take on e6 with the king, in which case there will be discovered checks once the black king moves away. <br /><br />Also, in the comments, people mention a perpetual check after 1...Nxf3+ 2.Qxf3 Qxe7 3.Qb3+ Kc6 4.Qa4+ Kd5 5.Qb3+.
