/></figure></div> <p>كلمة “غارم” مشتقة من كلمة “غرم” وهي تعني الدَّين. والغارم هو الشخص الذي في ذمّته دينٌ يجب عليه سداده، وهو من الأصناف المستحقة للزكاة كما نص عليه القرآن في الآية 60 من سورة التوبة. وبالتالي، فكلّ شخص مَدين لا يقدر على سداد دينه، له حقّ باستلام الزكاة ليسدّ به دينه.</p> <p>أجمع العلماء على أن الشخص الذي يقدر على قضاء دينه غير مستحقّ للزكاة. أما إذا كان قادراً على قضاء جزء من دينه، فيمكن إعطائه الزكاة لتسديد الجزء المتبقّي من دينه لا أكثر. وأجاز العلماء إعطاء الزكاة للشخص الذي يمتلك المال لقضاء دينه، لكنه سيصبح حين يسدّده في حاجة. </p> <p>أما في ما يتعلّق بالشروط التي تجعل الشخص في اعتبار الغارم، فهذا يختلف بحسب كل مذهب. ومن هذه الشروط ما يلي:</p> <ul><li>ألّا يكون الشخص قد اقترض بقصد الحصول على الزكاة. فيرى  المالكية أن هذا يمنع استحقاق الزكاة لأن يؤدي إلى تشجيع الناس على الاستدانة.</li><li>ألّا يكون الشخص قد اقترض للمعصية. فالزكاة تُعطى للذي يستدين لسبب شرعي فقط. وهذا رأي المذهب المالكي والشافعي والحنفي.</li></ul> <p>والجدير بالذكر بأن بعض العلماء قد قسّموا الدّين إلى نوعين:</p> <ol><li>الدَّين العادي، وذلك يكون باستدانة الشخص للمال لتغطية احتياجاته.</li><li>دَين الصلح. وهذا يحصل مثلاً حين يأخذ أحد الأشخاص على عاتقه دفع المال بنية حلّ النزاع بين طرفين. وهذا كان يحصل على سبيل المثال حينما كانت قبيلتان تتنازع قديماً وادّعت إحداهما بأن الثانية تسبّبت لها بأضرار لم تعترف بها هذه الأخيرة ورفضت دفع المال تعويضاً، فقام أحد الأشخاص بأخذ تكاليف الأضرار على عاتقه بهدف حلّ النزاع. يُسمَح بإعطاء الزكاة لهذا الشخص، وإلا فإن المشاكل والنزاعات لن تُحلّ. وهذا رأي المذهبين الشافعي والحنبلي.</li></ol> <p>وفي هذا السياق، إن أكثر من 50% من الأسر اللاجئة والنازحة تتراكم عليها الديون. فبعد أن خسروا منازلهم وممتلكاتهم، واستنفدوا مدّخراتهم، اضطرّ كثيرون لاستدانة المال بهدف تأمين احتياجات العيش الأساسية لأنفسهم ولأطفالهم، وخصوصاً المأوى والطعام والدواء والتعليم. وكثيراً ما تمتدّ الفترة التي يمضيها اللاجئون والنازحون بعيداً عن ديارهم سنوات طويلة. ويمكن أخذ الأزمة السورية كمثالٍ على هذا الأمر. فهذه الأزمة التي تُعدّ اليوم الأكبر في العالم تستمرّ لعام تاسع، ومن المستحيل الاعتماد على المدّخرات لفترة طويلة كهذه. وما يزيد من صعوبة واقع اللاجئين في هذه الحالات هو محدودية حصولهم على فرص عمل في البلدان المضيفة، وهو ما يدفع الأسر للاستدانة. ففي لبنان مثلاً، تتراكم الديون على حوالي 90% من الأسر السورية اللاجئة.</p> <p>وفي كثير من الحالات، كان العديد من اللاجئين والنازحين داخلياً فقراء أصلاً في بلدهم قبل اللجوء أو النزوح، وبالتالي فهم ليس لديهم أي مدّخرات، وفي حالات كثيرة أخرى أيضاً، هناك أسرٌ تعيلها أمهات أرامل بمفردهنّ. في اليمن، على سبيل المثال، يستخدم 10% من الأسر النازحة داخلياً المساعدات المالية من المفوضية لتسديد ديونهم.</p> <p>بالنظر إلى كل ما سبق، يمكن الفهم لما يُعتبر الدّين من المعايير الأساسية للمفوضية في تحديدها لمستوى حاجة وفقر الأسر، وهذا مشمول أيضاً في منهجيات المفوضية لتقييم مستوى الضعف لدى العائلات اللاجئة (VAF). إن صندوق الزكاة للاجئين يتّبع هذه المنهجية لتحديد مدى استحقاقية الأسر اللاجئة في الأردن ولبنان وغيرها من دول اللجوء في الحصول على المساعدة المالية وبالتالي الزكاة.</p> <p>أخيراً، من المهم أن نذكر في هذا السياق أيضاً الأثر الإيجابي الاجتماعي الذي يتركه تسديد الديون على حياة الأسر اللاجئة والنازحة، فهذا يحسّن من علاقاتهم الاجتماعية ويعزّزها حين يعيدون ما اقترضوه من أموال من الأقرباء والجيران أو مالكي البيوت التي يسكنونها (يعيش العدد الأكبر من اللاجئين في المدن والبلدات على عكس الاعتقاد السائد بأن معظمهم يعيش في المخيمات)، وبالتالي فإن ذلك يساهم أيضاً من حدّة التوتّرات الاجتماعية التي قد تواجهها هذه الأسر في الدول Laws regarding contributions to United Nations agencies vary from country to country. UNHCR does, however, partner with dedicated fundraising associations in a number of countries as well as having country specific offices with their own fundraising capacity. These countries include the USA, Germany, Spain, Japan, Australia, Italy, Canada, UK, South Korea, Hong Kong and Belgium.
