Qua tổng hợp, đa số đại biểu Quốc hội tán thành sự cần thiết xây dựng Luật Hóa chất (sửa đổi), bởi đây được xem là một ngành công nghiệp có tính nền tảng với mọi quốc gia, mọi nền kinh tế; xung quanh con người ở đâu cũng có hóa chất, sản phẩm hóa chất hội tụ, phục vụ và bủa vây. Vì thế rất cần phải ban hành Luật Hóa chất (sửa đổi) để kịp thời thể chế hóa các đường lối, chủ trương mới của Đảng trong lĩnh vực hóa chất và khắc phục kịp thời những vướng mắc, bất cập của Luật hiện hành, bảo đảm phù hợp với tình hình thực tiễn. Các đại biểu cũng đánh giá cao sự chuẩn bị về hồ sơ dự án luật. </span></span></span></span></p><p style="margin-top:8px;margin-bottom:8px;text-align:justify;"><span style="font-size:16px;"><span style="font-family:Arial, Helvetica, sans-serif;"><span style="color:#000000;"><span style="line-height:normal;">Theo Bộ trưởng, trong quá trình xây dựng dự thảo Luật, cơ quan soạn thảo đã quán triệt tinh thần chỉ đạo xuyên suốt của Lãnh đạo Đảng, Nhà nước hiện nay là: “<b><i>Xây dựng pháp luật theo hướng kiến tạo vừa bảo đảm yêu cầu quản lý nhà nước, vừa khuyến khích sáng tạo, giải phóng toàn bộ sức sản xuất</i></b><i>”, “<b>Dứt khoát từ bỏ tư duy không quản được thì cấm</b>”; “<b>Luật chỉ quy định những vấn đề khung, những vấn đề có tính nguyên tắc, không cần quá dài</b>”.</i> Đồng thời, cơ quan soạn thảo đã thực hiện nhất quán quan điểm của Chính phủ trình Quốc hội là: <b><i>Đẩy mạnh cắt giảm, đơn giản hóa thủ tục hành chính, áp dụng tối đa công nghệ thông tin nhằm giảm bớt nguồn lực quản lý và tạo thuận lợi cho doanh nghiệp; không làm ảnh hưởng đến hiệu lực, hiệu quả của quản lý nhà nước và bảo đảm tính đồng bộ, thống nhất của hệ thống pháp luật. </i></b></span></span></span></span></p><p style="margin-top:8px;margin-bottom:8px;text-align:justify;"><span style="font-size:16px;"><span style="font-family:Arial, Helvetica, sans-serif;"><span style="color:#000000;"><span style="line-height:normal;">Được sự thống nhất, đồng hành của cơ quan chủ trì thẩm tra, Bộ Công Thương đã có báo cáo tiếp thu, giải trình và gửi tới các đại biểu Quốc hội. </span></span></span></span></p><p style="margin-top:8px;margin-bottom:8px;text-align:justify;"><span style="font-size:16px;"><span style="font-family:Arial, Helvetica, sans-serif;"><span style="color:#000000;"><span style="line-height:normal;">Tại phiên thảo luận hôm nay đã có 11 lượt ý kiến tiếp tục góp ý vào dự thảo Luật. Bộ trưởng cam kết sẽ chỉ đạo Cơ quan soạn thảo nghiêm túc nghiên cứu, tiếp thu các ý kiến xác đáng của các Đại biểu để tiếp tục hoàn thiện dự thảo luật trình Quốc hội xem xét, thông qua; đồng thời để làm rõ thêm một số vấn đề mà Ủy ban Thường vụ Quốc hội gợi ý và nhiều đại biểu Quốc hội quan tâm, Bộ trưởng Nguyễn Hồng Diên đã đề cập, làm rõ 7 nhóm vấn đề.</span></span></span></span></p><p style="margin-top:8px;margin-bottom:8px;text-align:justify;"><span style="font-size:16px;"><span style="font-family:Arial, Helvetica, sans-serif;"><span style="color:#000000;"><span style="line-height:normal;"><b><i>Vấn đề thứ nhất</i></b><i>,</i> về tên gọi và phạm vi điều chỉnh áp dụng luật. </span></span></span></span></p><p style="margin-top:8px;margin-bottom:8px;text-align:justify;"><span style="font-size:16px;"><span style="font-family:Arial, Helvetica, sans-serif;"><span style="color:#000000;"><span style="line-height:normal;">Cơ quan soạn thảo cho rằng tên gọi Luật Hóa chất (sửa đổi) là phù hợp, kế thừa, phát triển Luật Hóa chất hiện hành và bao quát đầy đủ nội dung của 4 chính sách dự thảo luật cũng như phù hợp với Nghị quyết 41 của Ủy ban Thường vụ Quốc hội.</span></span></span></span></p><p style="margin-top:8px;margin-bottom:8px;text-align:justify;"><span style="font-size:16px;"><span style="font-family:Arial, Helvetica, sans-serif;"><span style="color:#000000;"><span style="line-height:normal;"><i>“Tiếp thu ý kiến đại biểu Quốc hội, cơ quan soạn thảo sẽ tiếp tục rà soát, làm rõ phạm vi điều chỉnh, nguyên tắc áp dụng bảo đảm bao hàm đầy đủ nội dung là quán triệt được các quan điểm, đường lối của Đảng và phù hợp với thông lệ quốc tế nhưng không làm phát sinh những mâu thuẫn, chồng chéo và xung đột với các luật khác có liên quan</i>”- Bộ trưởng nhấn mạnh.</span></span></span></span></p><p style="margin-top:8px;margin-bottom:8px;text-align:justify;"><span style="font-size:16px;"><span style="font-family:Arial, Helvetica, sans-serif;"><span style="color:#000000;"><span style="line-height:normal;"><b><i><span style="letter-spacing:-.1pt;">Vấn đề thứ hai</span></i><span style="letter-spacing:-.1pt;">,</span></b><span style="letter-spacing:-.1pt;"> về chính sách của Nhà nước trong lĩnh vực hóa chất. Các chính sách trong lĩnh vực hóa chất tại dự thảo luật đã thể chế hóa các chủ trương, chính sách của Đảng, Nhà nước về phát triển công nghiệp hóa chất được nêu tại Chiến lược phát triển kinh tế - xã hội 10 năm 2021-2030, Nghị quyết Hội nghị Trung ương 6 khóa XIII và các Kết luận 36-KL/TW, Kết luận 81-KL/TW của Bộ Chính trị về đẩy mạnh thực hiện chuyển đổi xanh kinh tế tuần hoàn, chuyển đổi năng lượng công bằng. </span></span></span></span></span></p><p style="margin-top:8px;margin-bottom:8px;text-align:justify;"><span style="font-size:16px;"><span style="font-family:Arial, Helvetica, sans-serif;"><span style="color:#000000;"><span style="line-height:normal;">Tiếp thu ý kiến của đại biểu, cơ quan soạn thảo sẽ tiếp tục phối hợp với các cơ quan có liên quan nghiên cứu bổ sung, làm rõ các giải pháp để thể chế hóa đầy đủ các chủ trương, chính sách của Đảng, Nhà nước phù hợp với thông lệ quốc tế để bổ sung vào dự thảo luật này và các luật khác có liên quan bảo đảm tính đồng bộ, thống nhất của hệ thống pháp luật.</span></span></span></span></p><p style="text-align:center;"><img alt="" width="600" height="399" src="/upload/2005517/fck/files/2024_11_23_12_47_132_a46df.png" /></p><p style="margin-top:8px;margin-bottom:8px;text-align:justify;"><span style="font-size:16px;"><span style="font-family:Arial, Helvetica, sans-serif;"><span style="color:#000000;"><span style="line-height:normal;"><b><i>Vấn đề thứ ba</i></b>, về phát triển công nghiệp hóa chất. </span></span></span></span></p><p style="margin-top:8px;margin-bottom:8px;text-align:justify;"><span style="font-size:16px;"><span style="font-family:Arial, Helvetica, sans-serif;"><span style="color:#000000;"><span style="line-height:normal;">Theo người đứng đầu ngành Công Thương, để thể chế đường lối, chủ trương của Đảng về phát triển công nghiệp, nhất là các ngành công nghiệp nền tảng, trong đó có công nghiệp hóa chất thì cần thiết phải xây dựng các cơ chế, chính sách phù hợp, đồng bộ và khả thi để thúc đẩy phát triển công nghiệp hóa chất. Bởi vì hóa chất ngày càng khẳng định vai trò vô cùng quan trọng đối với mọi nền kinh tế, góp phần hướng tới nền kinh tế độc lập, tự chủ. </span></span></span></span></p><p style="margin-top:8px;margin-bottom:8px;text-align:justify;"><span style="font-size:16px;"><span style="font-family:Arial, Helvetica, sans-serif;"><span style="color:#000000;"><span style="line-height:normal;"><i>“Theo đó, dự thảo luật giữ nguyên hình thức ưu đãi đầu tư theo quy định của Luật Đầu tư, đồng thời điều chỉnh quy định về đối tượng được hưởng ưu đãi hỗ trợ đầu tư, đặc biệt đối với các dự án thuộc lĩnh vực công nghiệp hóa chất trọng điểm và giao Chính phủ quy định chi tiết nhằm bảo đảm tính linh hoạt trong điều hành và phù hợp với thực tiễn hoạt động đầu tư trong lĩnh vực hóa chất</i>”- Bộ trưởng Nguyễn Hồng Diên cho hay. </span></span></span></span></p><p style="margin-top:8px;margin-bottom:8px;text-align:justify;"><span style="font-size:16px;"><span style="font-family:Arial, Helvetica, sans-serif;"><span style="color:#000000;"><span style="line-height:normal;">Tiếp thu ý kiến của đại biểu, trong thời gian tới, cơ quan soạn thảo sẽ tiếp tục rà soát, làm rõ mối quan hệ giữa chiến lược phát triển ngành công nghiệp hóa chất với hệ thống quy hoạch quốc gia; làm rõ đối tượng và chính sách ưu đãi đầu tư, chính sách huy động các nguồn lực xã hội nhằm tạo điều kiện cho các nhà đầu tư trong và ngoài nước quan tâm đầu tư vào lĩnh vực quan trọng này.</span></span></span></span></p><p style="margin-top:8px;margin-bottom:8px;text-align:justify;"><span style="font-size:16px;"><span style="font-family:Arial, Helvetica, sans-serif;"><span style="color:#000000;"><span style="line-height:normal;"><b><i>Vấn đề thứ tư,</i></b> về quản lý hoạt động hóa chất, nhất là hóa chất độc hại cần kiểm soát đặc biệt. </span></span></span></span></p><p style="margin-top:8px;margin-bottom:8px;text-align:justify;"><span style="font-size:16px;"><span style="font-family:Arial, Helvetica, sans-serif;"><span style="color:#000000;"><span style="line-height:normal;">Để tăng cường quản lý hóa chất độc hại, kiểm soát rủi ro, mất an toàn, an ninh từ hóa chất, cơ quan soạn thảo đã đề xuất sửa đổi, bổ sung vào dự thảo Luật Hóa chất (sửa đổi) một số quy định như sau:</span></span></span></span></p><p style="margin-top:8px;margin-bottom:8px;text-align:justify;"><span style="font-size:16px;"><span style="font-family:Arial, Helvetica, sans-serif;"><span style="color:#000000;"><span style="line-height:normal;"><i>Một là,</i> sửa đổi, bổ sung quy định hóa chất trong toàn bộ vòng đời từ khi hóa chất được tạo ra hoặc đưa vào lãnh thổ Việt Nam đến khi lưu thông, sử dụng và xử lý. Theo đó, dự thảo luật đã bổ sung các quy định quản lý các hoạt động nhập khẩu, sản xuất, kinh doanh, vận chuyển hóa chất với mức độ chặt chẽ khác nhau nhằm bảo đảm và phù hợp với từng danh mục hóa chất, an toàn trong sản xuất sử dụng hóa chất, bảo đảm an toàn cho môi trường.</span></span></span></span></p><p style="margin-top:8px;margin-bottom:8px;text-align:justify;"><span style="font-size:16px;"><span style="font-family:Arial, Helvetica, sans-serif;"><span style="color:#000000;"><span style="line-height:normal;"><i>Hai là</i>, bổ sung biện pháp tiền kiểm đối với hoạt động nhập khẩu hóa chất cần kiểm soát đặc biệt, thay vì việc doanh nghiệp chỉ cần thực hiện khai báo hóa chất tự động như hiện nay, dồng thời đề xuất tăng chế tài xử phạt các vi phạm để nâng cao mức răn đe.</span></span></span></span></p><p style="margin-top:8px;margin-bottom:8px;text-align:justify;"><span style="font-size:16px;"><span style="font-family:Arial, Helvetica, sans-serif;"><span style="color:#000000;"><span style="line-height:normal;"><i>Ba là</i>, bổ sung quy định về áp dụng công nghệ thông tin, chuyển đổi số trong việc kiểm soát hoạt động mua bán hóa chất cần kiểm soát đặc biệt nhằm giám sát toàn bộ đường đi của hóa chất, từ nhà sản xuất nhập khẩu đến người sử dụng cuối cùng.</span></span></span></span></p><p style="margin-top:8px;margin-bottom:8px;text-align:justify;"><span style="font-size:16px;"><span style="font-family:Arial, Helvetica, sans-serif;"><span style="color:#000000;"><span style="line-height:normal;"><i>Bốn là</i>, sửa đổi, bổ sung quy định tăng cường phân cấp quản lý cho địa phương và các bộ, ngành liên quan trong việc quản lý đối với các đơn vị cung cấp dịch vụ tồn trữ, vận chuyển hóa chất cần kiểm soát đặc biệt nhằm tăng cường bảo đảm công tác an toàn, an ninh, tránh thất thoát hóa chất hoặc sử dụng không đúng mục đích; đồng thời, quy định rõ phân cấp thẩm định kế hoạch phòng ngừa, ứng phó sự cố hóa chất và nhất là sự cố cháy, nổ cho các địa phương để bảo đảm tính chủ động, kịp thời như nhiều đại biểu đã quan tâm.</span></span></span></span></p><p style="margin-top:8px;margin-bottom:8px;text-align:justify;"><span style="font-size:16px;"><span style="font-family:Arial, Helvetica, sans-serif;"><span style="color:#000000;"><span style="line-height:normal;"><i>Năm là</i>, bổ sung quy định tổ chức, cá nhân sử dụng hóa chất cần kiểm soát đặc biệt phải đăng ký mục đích, nhu cầu sử dụng hóa chất trên cơ sở dữ liệu nhằm thiết lập hệ thống thông tin phục vụ công tác quản lý nhà nước, đặc biệt là công tác hậu kiểm nhằm hạn chế đến mức thấp nhất việc hóa chất bị sử dụng sai mục đích.</span></span></span></span></p><p style="margin-top:8px;margin-bottom:8px;text-align:justify;"><span style="font-size:16px;"><span style="font-family:Arial, Helvetica, sans-serif;"><span style="color:#000000;"><span style="line-height:normal;"><i>Sáu là</i>, vì là hóa chất độc hại cho nên cần có quy định rất cụ thể về sản xuất, tồn trữ hóa chất độc hại phải ở địa điểm xa khu dân cư và phải có cơ chế kiểm soát đặc biệt đối với loại hóa chất này trong quá trình sử dụng và lưu thông.</span></span></span></span></p><p style="margin-top:8px;margin-bottom:8px;text-align:justify;"><span style="font-size:16px;"><span style="font-family:Arial, Helvetica, sans-serif;"><span style="color:#000000;"><span style="line-height:normal;">“<i>So với Luật Hóa chất hiện hành, Luật Hóa chất (sửa đổi) đã đồng bộ với các quy định để siết chặt tăng cường quản lý hoạt động hóa chất trong toàn bộ vòng đời, đặc biệt là đối với hóa chất cần kiểm soát đặc biệt. Tăng cường phân cấp, phân quyền, chia sẻ cơ sở dữ liệu để nâng cao hiệu quả quản lý ở cả cấp trung ương và địa phương</i>”- Tư lệnh ngành Công Thương khẳng định và cho biết thêm, thời gian tới, cơ quan soạn thảo sẽ tiếp tục phối hợp chặt chẽ với cơ quan quản lý các lĩnh vực sử dụng hóa chất trong việc nghiên cứu, đánh giá rủi ro có thể phát sinh từ khâu sử dụng và đánh giá chi tiết tác động chính sách để đề xuất các giải pháp quy định quản lý các loại hóa chất độc hại, hóa chất đặc biệt nguy hiểm, bảo đảm chặt chẽ và hiệu quả.</span></span></span></span></p><p style="margin-top:8px;margin-bottom:8px;text-align:justify;"><span style="font-size:16px;"><span style="font-family:Arial, Helvetica, sans-serif;"><span style="color:#000000;"><span style="line-height:normal;"><b><i>Vấn đề lớn thứ năm</i></b> là vấn đề hóa chất nguy hiểm trong sản phẩm, hàng hóa và an toàn hóa chất. </span></span></span></span></p><p style="margin-top:8px;margin-bottom:8px;text-align:justify;"><span style="font-size:16px;"><span style="font-family:Arial, Helvetica, sans-serif;"><span style="color:#000000;"><span style="line-height:normal;">Theo Bộ trưởng, ý kiến của các đại biểu về nội dung này chủ yếu tập trung đánh giá sự phù hợp với các quy định của pháp luật có liên quan nhằm bảo đảm thuận lợi trong quá trình thực thi của doanh nghiệp cũng như phù hợp với năng lực thực thi của các cơ quan quản lý nhà nước sau khi luật được ban hành.</span></span></span></span></p><p style="margin-top:8px;margin-bottom:8px;text-align:justify;"><span style="font-size:16px;"><span style="font-family:Arial, Helvetica, sans-serif;"><span style="color:#000000;"><span style="line-height:normal;">Các vấn đề này đã được cơ quan soạn thảo nghiên cứu, đánh giá kỹ lưỡng trong quá trình xây dựng dự thảo luật và sẽ tiếp tục hoàn thiện dự thảo để trình với các đại biểu Quốc hội.</span></span></span></span></p><p style="margin-top:8px;margin-bottom:8px;text-align:justify;"><span style="font-size:16px;"><span style="font-family:Arial, Helvetica, sans-serif;"><span style="color:#000000;"><span style="line-height:normal;">Tiếp thu ý kiến đại biểu, cơ quan soạn thảo sẽ tiếp tục nghiên cứu, làm rõ các nội dung nêu trên, nhất là vấn đề chia sẻ dữ liệu để làm tốt công tác quản lý và báo cáo Quốc hội trong kỳ họp tới.</span></span></span></span></p><p style="margin-top:8px;margin-bottom:8px;text-align:justify;"><span style="font-size:16px;"><span style="font-family:Arial, Helvetica, sans-serif;"><span style="color:#000000;"><span style="line-height:normal;"><b><i>Vấn đề thứ sáu</i></b>, quản lý nhà nước về hóa chất. </span></span></span></span></p><p style="margin-top:8px;margin-bottom:8px;text-align:justify;"><span style="font-size:16px;"><span style="font-family:Arial, Helvetica, sans-serif;"><span style="color:#000000;"><span style="line-height:normal;">Bộ trưởng Nguyễn Hồng Diên cho rằng, với tính đa dụng, hóa chất có thể được sử dụng trong nhiều ngành, nhiều lĩnh vực khác nhau. Do đó, một loại hóa chất có thể có nhiều bộ, ngành cùng quản lý tùy theo mục đích sử dụng. Vì vậy, áp dụng triệt để nguyên tắc tăng cường phân cấp, phân quyền, dự thảo Luật đã quy định rõ trách nhiệm quản lý của từng bộ, ngành, địa phương và đơn vị chức năng. </span></span></span></span></p><p style="margin-top:8px;margin-bottom:8px;text-align:justify;"><span style="font-size:16px;"><span style="font-family:Arial, Helvetica, sans-serif;"><span style="color:#000000;"><span style="line-height:normal;">“<i>Tuy nhiên, để bảo đảm tính linh hoạt trong điều hành và tính ổn định lâu dài của luật, cơ quan soạn thảo sẽ nghiên cứu tiếp thu theo hướng chỉ đưa vào luật những điều khoản quy định thuộc thẩm quyền của Quốc hội, những nội dung chi tiết sẽ giao Chính phủ quy định, đồng thời tiếp tục rà soát, đánh giá, quy định trách nhiệm quản lý rõ ràng của các cơ quan quản lý trong sản xuất, vận chuyển, tồn trữ hóa chất và tiếp tục rà soát, đánh giá nguồn lực của các cơ quan quản lý nhà nước tại trung ương, địa phương để bảo đảm việc phân cấp và thực hiện phân quyền, phân cấp một cách hiệu quả</i>.”- Bộ trưởng nhấn mạnh.</span></span></span></span></p><p style="margin-top:8px;margin-bottom:8px;text-align:justify;"><span style="font-size:16px;"><span style="font-family:Arial, Helvetica, sans-serif;"><span style="color:#000000;"><span style="line-height:normal;"><b><i>Vấn đề thứ bảy</i></b>, về thủ tục hành chính và điều khoản chuyển tiếp. </span></span></span></span></p><p style="margin-top:8px;margin-bottom:8px;text-align:justify;"><span style="font-size:16px;"><span style="font-family:Arial, Helvetica, sans-serif;"><span style="color:#000000;"><span style="line-height:normal;">Bộ trưởng nêu rõ, dự thảo Luật quy định 12 nhóm thủ tục hành chính, trong đó phát sinh 4 nhóm thủ tục hành chính mới, nhưng đồng thời bãi bỏ 9 nhóm thủ tục hành chính hiện hành. Như vậy, số thủ tục hành chính trong lĩnh vực hóa chất sẽ giảm đi 5 nhóm so với quy định hiện nay. Các thủ tục hành chính tại dự thảo Luật được nghiên cứu, xây dựng theo hướng tuân thủ triệt để nguyên tắc tăng cường phân cấp, phân quyền, đồng thời, đơn giản hóa quy trình, đẩy mạnh ứng dụng công nghệ thông tin trong quản lý.</span></span></span></span></p><p style="margin-top:8px;margin-bottom:8px;text-align:justify;"><span style="font-size:16px;"><span style="font-family:Arial, Helvetica, sans-serif;"><span style="color:#000000;"><span style="line-height:normal;">Về nội dung chuyển tiếp, cơ quan soạn thảo sẽ nghiên cứu, tiếp thu theo hướng bảo đảm các đối tượng bị tác động không bị ảnh hưởng tiêu cực cũng như vướng mắc trong quá trình thực hiện quyền, nghĩa vụ với cơ quan quản lý nhà nước; đồng thời, trong thực tiễn sản xuất, kinh doanh thì quyền, nghĩa vụ của các đối tượng bị tác động sẽ được bảo đảm theo quy định của luật hiện hành, trường hợp có vướng mắc phát sinh trong quá trình chuyển tiếp thì đề nghị Quốc hội giao Chính phủ quy định cụ thể.</span></span></span></span></p><p style="text-align:justify;margin-bottom:13px;"><span style="font-size:16px;"><span style="font-family:Arial, Helvetica, sans-serif;"><span style="color:#000000;"><span style="line-height:115%;"><span style="line-height:115%;">Đối với các ý kiến khác của Đại biểu, cơ quan chủ trì soạn thảo sẽ tiếp tục nghiên cứu, tiếp thu để hoàn thiện dự thảo Luật. "<i>Sau phiên thảo luận hôm nay, chúng tôi sẽ cùng cơ quan chủ trì thẩm tra nghiên cứu kỹ lưỡng, tiếp thu tối đa các ý kiến xác đáng của các đại biểu để hoàn thiện dự thảo Luật, trình Quốc hội xem
