DEFINITIONS</a> In these terms and conditions of sale and use, the words or expressions mentioned below, beginning with a capital letter, shall have the following meanings: <blockquote> - Le Monde : refers to the Société Editrice du Monde, a public limited company with a board of directors and a supervisory board with a capital of 124,610,348.70 euros, registered with the Paris Trade and Companies Register under number B 433 891 850, with its registered office at 67/69 avenue Pierre Mendès France 75013 Paris, France. - General Terms and Conditions : shall refer to the present general terms and conditions of sale and use, applicable to all Products and/or Services offered by Le Monde. - Special Conditions : refers to the special conditions of sale and use that apply to the Products and/or Services Le Monde offers private individuals. The Special Conditions are presented in the order or registration forms specific to each Product and/or Service. The Special Conditions for the primary Products and/or Services offered by Le Monde are set listed in <a href="#ancre_annexe" target="_parent">Appendix I</a> of the General Terms & Conditions and form an integral part thereof. The Special Conditions may vary according to the geographical area from which the order is placed. - Purchase Order : designates the contractual conditions negotiated by mutual agreement and that apply to the Products and/or Services Le Monde offers professional Customers and/or legal entities. The main Products and/or Services offers that Le Monde proposes to professionals and legal entities are presented in Appendix I a of the General Terms and Conditions and form an integral part thereof. An Order Form is any written document expressing the Customer's commitment, especially a quotation signed or accepted by any means or email. The Purchase Order is drawn up based on the number of Beneficiaries declared by the Customer. If, during the Contract’s duration, Le Monde ascertains that the number of Beneficiaries is greater than the number declared, Le Monde reserves the right to increase the price initially agreed after notifying the Customer. - Beneficiary : refers to a natural or legal entity designated by a Customer who will benefit from the advantages of the Contract of which they are a signatory. A person who has agreed to become a Beneficiary is deemed to have likewise accepted the Contract’s clauses in terms of their use of the Products and/or Services. - Order Form : refers to the special terms and conditions applicable to certain Products and/or Services offered by Le Monde to professionals and legal entities. An order form is preceded by a quote that meets the specific needs requested by a client. - Contract : means the set of General Terms and Conditions and, if applicable, the Special Conditions applicable between Le Monde and a User and/or a Customer. It constitutes the entire agreement between them. - Customer : means a natural or legal person linked to Le Monde by a Contract concerning Products and/or Services provided for a fee. A Customer must be a natural person of legal age and/or legally capable. - User : means a natural or legal person linked to Le Monde by a Contract concerning Products and/or Services provided for a fee. A minor may be a User with the prior authorization and under the responsibility of their parents or guardians, who are responsible for the minor’s compliance with the General Terms and Conditions and, if applicable, the Special Conditions. - Products and/or Services : refers to any product and/or service provided to the User and/or Customer and/or Beneficiary, whether free of charge or in exchange for payment, by Le Monde. - Order : refers to the actions of a natural or legal entity, User and/or Customer expressing their firm intention to acquire a Product or subscribe to a Service offered by Le Monde for a fee. A User who places an order becomes a Customer. - Website : refers to the online non-specialist information service published by Le Monde, accessible at <a href="https://www.lemonde.fr" target="_blank">www.lemonde.fr</a>. All the pages dedicated to the Products and/or specific Services are attached to the Website and accessible from it, including in particular the subscription pages <a href="https://abo.lemonde.fr" target="_blank">abo.lemonde.fr</a> and <a href="https://abosh.lemonde.fr" target="_blank">abosh.lemonde.fr</a>. - Online Shop : refers to the online mail order service published by Le Monde, accessible from the Website or directly at the address <a href="https://boutique.lemonde.fr" target="_blank">boutique.lemonde.fr</a>. - Applications : refers generally to applications that can be downloaded and executed from the operating system of a smartphone or tablet, published by Le Monde, available on the Apple Store, Google Play and/or any other downloading platform chosen by Le Monde. - Account : refers to the personal space made available to the User and/or Customer and/or Beneficiary on the Website and/or Applications, allowing them, after signing in with a personal access code, to access all or part of the Products and/or Services as well as the data related to their Contract, and to modify it. FOREWORD The General Terms and Conditions apply to the offer of Products and/or Services as proposed by Le Monde. They are supplemented, if necessary, by the Special Conditions. General Terms and Conditions and, if necessary, the Special Conditions or the Order Form constitute the Contract binding Le Monde to the User and/or Customer and/or Beneficiary. The User thus undertakes to read them carefully and acknowledges that the use of, subscription to and/or Order for Products and/or Services of Le Monde implies their acceptance without restriction or reservation. The General Terms and Conditions and the Special Conditions may be modified at any time by Le Monde, in order to comply with any editorial, commercial, technical, legal or regulatory changes. The new General Terms and Conditions and Special Conditions will be applicable to the User and/or Customer as of their posting on the Website and applied to uses, subscriptions and/or orders occurring as of that date. We therefore recommend that you refer to the current version of the General Terms and Conditions and/or the Special Conditions before any new use, subscription or order. These Conditions are available on the Website and can be requested from Customer Service. Users with in-progress Contracts will be notified of any substantial changes to the General Terms and Conditions and Special Conditions with a minimum of one month’s notice. If the User and/or Customer does not terminate the contract within this period, they are deemed to accept the new contractual conditions. Order Forms may only be altered during a Contract’s term by the Parties’ mutual agreement. PRODUCTS AND/OR SERVICES OF LE MONDE The main Products and/or Services offered by Le Monde are presented in this article and Appendix I of the General Terms and Conditions under "Special Conditions" and Appendix I a under "Corporate and legal entity offers". Le Monde reserves the right at any time, in accordance with the legal and regulatory provisions in force, to modify, change, subject to conditions, suspend, withdraw or delete all or part of the Products and/or Services. <blockquote> 1. Press publications </blockquote> Le Monde publishes the following press publications: <blockquote> - Le Monde: daily general information press publication and its supplements, including M le magazine du Monde. The quantity, topics, and day that Le Monde’s supplements are published are subject to change by decision of Le Monde’s newsroom. Le Monde is published six days a week (from the Tuesday edition to the Sunday-Monday edition). An issue corresponding to a public holiday may be included in a double or triple issue published on the day before or two days before the public holiday. Le Monde is distributed in a print version and in a digital version. - Le Monde special issues: non-periodical press publications dedicated to a specific topic. Le Monde special issues are distributed in an edition printed on paper. They are not included in the subscription offers. They can be ordered through the Le Monde Online Shop. Some Le Monde special issues are available in digital form only for certain Users and/or Customers, subject to certain conditions. - The Weekly Selection: a weekly press publication that gives an overview of the major French and international news events of the past week with a selection of articles published in Le Monde. The Weekly Selection is published every Friday. The Weekly Selection is in an edition printed on paper. </blockquote> <blockquote> 2. Subscription and renewal offers for publications </blockquote> Le Monde offers different subscription and renewal offers for its publications. These offers may vary depending on the geographical area the order is placed from. A subscription entitles the Customer and/or the Beneficiary to receive a periodical publication published by Le Monde at regular intervals. Any subscription taken out during a period of six months following the end of a previous subscription taken out by the Customer or with the same means of payment and relating to the same publication shall be considered a renewal, including if the previous Contract gave rise to right of withdrawal. A subscription can concern: <blockquote> - The paper version of a publication This is then delivered, at a frequency and for a duration dictated by the specific offer to which the Customer and/or the Beneficiary subscribed, to the address this latter has given. - The digital version of a publication, if it exists The publication may be accessed by the Customer on the Website and/or the Applications. The Customer and/or the Beneficiary may access the publication via the Website and/or the Applications. - Print and digital versions simultaneously (mixed subscription) </blockquote> The main subscription and renewal offers that Le Monde proposes are presented in <a href="#ancre_annexe">Appendices I</a> and <a href="#ancre_annexe_a">I a</a>. Website and Applications </blockquote> The Website and/or the Applications provide access to the digital Products and/or Services offered by Le Monde. Access to and use of the Website and/or the Applications requires an internet connection. The User and/or Customer and/or Beneficiary alone are responsible for the technical and computer resources required for this connection, in particular a computer, smartphone or tablet, software, browser, and telecommunication network, Le Monde having no obligation whatsoever in this respect. Access to and use of the Website and/or the Applications is provided in exchange for a consideration of the User’s choice. This consideration may be: - Direct , in the form of a subscription to an Offer taken out by the User. - Indirect , in the form of revenue generated for the Publisher through the sale of targeted advertising campaigns on the Website. This consideration implies the acceptance of cookies that are not exempt from consent by the Users of the Website. This consideration allows Users to access a selection of articles. In any event, Users and/or Customers and/or Beneficiaries are hereby informed that the development and operation of the Website and/or Applications are financed partially by revenues derived from advertising in dedicated promotional spaces. Signing up for a Subscription Offer and accepting consent-exempt cookies will only prevent the display of personalized advertisements, and not of non-personalized advertisements. The use of the Website and/or the Applications implies the acceptance of said advertisements. Should the User and/or Customer and/or Beneficiary use any ad-blocking solution on the device they use for access, Le Monde is authorized to trigger any technical means they deem fit to prevent access to the Website. <blockquote> a. Rules for Website and/or Application Use </blockquote> When the User and/or Customer and/or Beneficiary uses the Website and/or a Le Monde App, they agree: <blockquote> - Respect the laws and regulations in force, public order and good morals. - In particular, not to put online, record or transmit elements inciting discrimination, hatred of a person or a group of persons because of their political opinions, their origin or their membership or non-membership, real or supposed, to a specific ethnic group, nation, race or religion, or their sexual orientation. - Not to hinder or disrupt the operation of the Website and/or Applications as well as the associated servers and networks, in particular by jeopardizing their operation, security or integrity. - Not to use viruses, inject computer bugs or exploit any other form of vulnerability to obtain benefits or access to protected data from the Website and/or Applications. - Immediately notify Le Monde if they discover a security flaw the Website and/or the Applications. - Not to collect, store or distribute the contents of the Website and/or Applications, whether wholly or partially, to any third party. It is also strictly forbidden, without the prior written consent of Le Monde, to crawl the Site and/or the Applications and/or to mass-collect their content, by any means and for any purpose whatsoever, and in particular in order to develop or train any software program, including, without limitation, programs based on artificial intelligence. - Not to put online, record, or transmit by any means whatsoever content of an advertising or promotional nature, commercial solicitations, or classified ads of any kind. - Not to infringe the rights of a third party - Not to post, record or transmit copyrighted material, unless they can guarantee they have obtained the permission of the rights holder and can provide proof of this. - Not to collect, store or disseminate the personal data of any third party, whether or not that third party is a User and/or Customer and/or Beneficiary. - Not to harass, denigrate or insult a third party in any way whatsoever, whether or not that third party is a User and/or Customer and/or Beneficiary. - Not to attempt to mislead other Users and/or Customers and/or Beneficiaries by usurping the name, pseudonym or corporate name of another natural or legal entity. - Not to disparage Le Monde, its publications, Products and/or Services. </blockquote> <blockquote> b. Customer Contributions - Feedback Charter </blockquote> For certain Products and/or Services on the Website and/or Applications, the Customer and/or Beneficiary has the option of publishing personal contributions online (particularly in the form of feedback or comments) and to viewing the contributions published by other Customers and/or Beneficiaries. This feature is ancillary, and Le Monde may at any time impose conditions on it or remove it, without such a decision being considered as a modification or a breach of contract. Contributions by Customers and/or Beneficiaries must comply with the General Terms and Conditions, especially with the above-mentioned rules governing use of the Website and/or Applications, as well as the <a href="https://www.lemonde.fr/actualite-medias/article/2019/05/21/l-espace-des-contributions-du-monde-en-10-questions_5465155_3236.html" target="_blank">Feedback Charter</a>. Should this contractual framework be breached, Le Monde reserves the right not to post or to delete all or part of the Customer's and/or Beneficiary's contributions, and/or to temporarily or permanently prohibit them from accessing this feature, and/or to terminate the current Contract, without the Customer being entitled to claim any compensation. Contributions are associated with the User ID that was chosen by the Customer and/or Beneficiary, who is the author when opening their Account, as well as with the date they were posted, as from the entry into force of the General Terms and Conditions. The Customer acknowledges that they are aware of and accepts that their user ID shall be made public, so that their contributions may be attributed to them. The Customer and/or the Beneficiary is hereby informed that they shall be liable for the contributions they make public when posting them on the Website and/or Applications. As such, they guarantee Le Monde against any consequences of a possible investigation, action or conviction related to one of their contributions. Closing an Account does not mean that the contributions made by the Customer and/or Beneficiary concerned will be deleted, but no further contributions may be added. However, Le Monde may decide at any time to delete all or part of the contributions. Le Monde makes no commitment to save, even temporarily, a copy of any deleted contributions. It is therefore up to the Customer to save a copy of their contributions, if they so desire, in order to avoid losing their data. Le Monde has decided, without this constituting any obligation on its part, to set up a system of automatic or human moderation of all or part of the contributions. However, the Customer is fully responsible for the messages they post and the consequences that may result from them. <blockquote> c. Creating an Account on the Website and/or Applications </blockquote> Certain Products and/or Services accessed from the Website and/or Applications require the User and/or Customer and/or Beneficiary to create an Account. Only one Account may be created per User and/or Customer and/or Beneficiary. Creating an Account is a declarative procedure enabling the User and/or Customer and/or Beneficiary to enter a certain amount of personal information so that it can be associated with the access rights they have all or part of the Products and/or Services on the Website and/or Applications. The Account has access codes, i.e. a username and a password, chosen by the User and/or Customer and/or Beneficiary, enabling them to identify themselves on the Website and/or Applications, to log to their Account and to enjoy the associated Products and/or Services. When creating their Account, the User and/or Customer and/or Beneficiary undertakes to provide accurate and complete information. They agree to keep this information up to date for as long as their Account is valid. The access codes allow the User and/or Customer to log in from only one device at a time. Attempting to log in simultaneously from another device with the same access codes will automatically close the first open session. These access codes are personal and confidential. Each User and/or Customer and/or Beneficiary acknowledges and agrees that any login to the Website and/or the Applications, and any use of a Product and/or Service or any Order placed via their Account are deemed to have originated from them. The User and/or Customer and/or Beneficiary undertakes to keep their access codes secret and to refrain from disclosing them in any form whatsoever to third parties. They are also invited to log out at the end of each visit to the Website and/or the Applications. Should the User and/or Customer and/or Beneficiary forget their password, they may recover it via the "<a href="https://secure.lemonde.fr/sfuser/password/lost">Forgot your password?</a>" feature or through the following link: <a href="https://secure.lemonde.fr/sfuser/password/lost" target="_blank">https://secure.lemonde.fr/sfuser/password/lost</a>. If their password is accidentally disclosed or stolen, the User and/or Customer and/or Beneficiary must inform Customer Service as soon as possible so that it can deactivate and replace the password. The User and/or Customer and/or Beneficiary will then be required to choose a new password and possibly a new username.In the absence of prompt or immediate action, the User and/or Customer and/or Beneficiary will be held responsible for the consequences of any loss, theft, misappropriation or unauthorized use of their access codes. In order to protect as much as possible against possible attacks on the confidentiality of their Account and the information contained therein, we highly recommend that the User and/or Customer and/or Beneficiary choose a strong, original password and that they change it regularly. Le Monde declines all responsibility for anything that is directly linked to the User and/or Customer and/or Beneficiary, having chosen a password that was not sufficiently complex. <blockquote> d. Account Deactivation </blockquote> Users and/or Customers and/or Beneficiaries wishing to deactivate their Account must contact Customer Service. Deactivation of the Account will result in it being impossible to access Products and/or Services that require identification of the User and/or Customer and/or Beneficiary via signing into their Account. Le Monde reserves the right to automatically suspend the User's and/or Customer's and/or the Beneficiary's Account without prior notice or compensation, either temporarily or permanently, in the following cases: Serious and/or repeated non-compliance with the General Terms and Conditions, especially the rules governing use of the Website and/or Applications, the Special Conditions or the Feedback Charter; all actions contrary to Le Monde’s interests; provision of false information when creating the Account; Account inactivity for twelve consecutive months. However, the Account cannot be deactivated for inactivity if it is linked to a current Subscription Contract. <blockquote> 4. « La lettre aux abonnés » </blockquote> « La Lettre aux Abonnés » is a service included in certain subscription offers. It enables the Customer and/or Beneficiary to receive a selection of articles each month by email that should not have been missed from the previous month, as well as dedicated content and services. Although it is a product that is included in certain subscription offers, the Customer and/or Beneficiary has the option of deactivating this service if they no longer wish to use it after the Contract ends. This deactivation, however, does not give rise to a discount on the fixed cost of the subscription. <blockquote> 5. Le Monde Shop </blockquote> The Le Monde Shop is an online mail order service for products such as: Le Monde special issues, cultural products and merchandising. <blockquote> a. Products for sale in the shop - Product Descriptions </blockquote> Le Monde makes its best effort to provide the User and/or Customer with the most complete information concerning the Products sold in the Online Shop. However, the descriptions and illustrations of the Products are purely indicative and have no contractual value, and Le Monde may not be held accountable for their non-compliance. <blockquote> - Product Availability </blockquote> The Products are offered for sale in the Shop within the limit of the available inventory. They can only be shipped to metropolitan France and Monaco. As far as possible, information on the availability of Products is communicated to the User and/or Customer at the time of the Order. However, if a Product becomes unavailable after the Order has been placed, Le Monde will contact the Customer to offer a replacement Product or, if necessary, to cancel the Order. The case of a cancellation, the Customer will be reimbursed for all amounts paid to Le Monde for said Product, to the exclusion of any compensation. <blockquote> - Pre-order products </blockquote> Some Products, which are not yet available for sale, may be offered for pre-order to all or part of the Users and/or Customers, subject to conditions. These conditions, as well as the estimated delivery date of the Product, are specified in the Product description. <blockquote> b. Retention of title clause </blockquote> The Products offered for sale on the Shop are the property of Le Monde until full payment of the sale price has been received. <blockquote> 6. Other Products and Services a. Le Monde Mémorable </blockquote> Le Monde Mémorable is an online service, accessible from the Website and/or the Applications, that allows you to expand your memory and general knowledge in a fun way. It is presented in the form of: - lessons on a specific topic; - knowledge tests and answers; - a personalised study programme. Le Monde Mémorable is based on the concept of a personalised learning path, meaning a sequence of lessons defined according to the Customer’s interests and test results. Access to Le Monde Mémorable requires a specific Subscription, separate from the Subscription to a digital publication. The different offers that include access to Le Monde Mémorable are listed in the Special Conditions. They depend on the commitment duration and the number of lessons the Customer wishes to access. The price of each package is fixed and non-refundable, regardless of the actual time the Customer uses the Service. <blockquote> b. Newsletters </blockquote> On the Website and/or the Applications, Le Monde offers a newsletter service that allows you to receive, free of charge or for a fee, a general or themed newsletter at a set frequency. Subscription to a newsletter can be free, by simply registering an email address, or subject to conditions. Any special conditions applicable to a newsletter are mentioned in the corresponding registration form. It is possible to unsubscribe from a newsletter at any time, either by clicking on the unsubscribe link in each newsletter, or through your user Account, or with Customer Service. <blockquote> c. Le Monde Jeux </blockquote> Le Monde Jeux is an online service that can be accessed via the Website and/or the Applications, providing subscription-based access to word games: - Le Monde’s crossword puzzles, created since 1997 by author Philippe Dupuis: access to all the archives as well as new puzzles published daily in Le Monde (12×10) and weekly in M le magazine du Monde (15×15). - Mini crossword puzzles: access to a database of crossword puzzles in a new, smaller, easier grid format (7×7), created by Philippe Dupuis, the author of Le Monde crossword puzzles. A new puzzle is added to the database every day. - Le Monde’s Sudoku puzzles, created by author Yan Georget: access to all the archives as well as new Sudoku puzzles published daily in Le Monde and weekly in M le magazine du Monde. Access to Le Monde Jeux is included with some Le Monde subscription packages (cf. <a href="#ancre_annexe" target="_parent">see special conditions</a>) as well as through a specific subscription for this service. <blockquote> d. Le Monde Ateliers </blockquote> Le Monde Ateliers is a service that offers courses or conferences led by well-known figure in a specific field (hereafter referred to as the «Ateliers”). Ateliers can consist of one or more sessions. They can be conducted either face-to-face only, face-to-face and live online, or exclusively online and streaming. The specific conditions applicable to each Atelier or series of Ateliers indicate the number of sessions and their dates, the terms of participation and/or access, and the period of online availability. The Ateliers are subject to payment and the conditions presented on the dedicated website: <a href="https://ateliers.lemonde.fr/" target="_blank">ateliers.lemonde.fr</a> For a series of Ateliers, the Customer must pay for the entire series. When attending an Ateliers course, the customer must pay for the full course. The participation price is fixed and no refund, either full or partial, shall be offered in the event of the customer’s absence, for whatever reason. Customers may also purchase a subscription offer, which gives access to all Ateliers and Ateliers courses presented exclusively online or via streaming. Details of this offer are set out in the special conditions pertaining to the “Le Monde Ateliers” subscription package, which are appended to these general terms and conditions. In order to subscribe to a “Le Monde Ateliers” offer, the customer must have, or create, an account on the www.lemonde.fr website. Subscriptions may only be purchased online. After logging into their account, the customer may choose their desired subscription offer and pay via the secure payment platform. The subscription is valid in the customer’s name only and may not be transferred, whether free of charge or in exchange for a fee. If purchasing an offer for a third party, the customer must ensure that the individual concerned fulfills the participation criteria and agrees to the use of their personal data by “Le Monde Ateliers” within this context (particularly with regard to the sending of confirmation and invitation emails). To register for an Atelier or a series of Ateliers, the Customer must have or create an Account on the <a href="https://www.lemonde.fr" target="_blank">www.lemonde.fr</a> website. After signing in to their Account, the Customer can choose the Atelier or series of Ateliers they would like to attend and pay the indicated price via the secure payment platform. Registration and payment for an Atelier or a series of Ateliers shall be done exclusively online. Customers are informed that it is strictly forbidden to make any audio, video, digital or technical recordings of the Ateliers they attend or view via streaming. Le Monde reserves the right to cancel an Atelier or a series of Ateliers if the minimum number of participants is not reached or for any other legitimate reason beyond its control. In this case, Le Monde shall not owe any compensation to the Customer other than the refund of the amount paid. No such refund shall be due in the context of a “Le Monde Ateliers” subscription offer. Face-to-face Ateliers shall take place either at Le Monde’s offices - 67/69 avenue Pierre Mendès-France, 75013 Paris, France - or at the location indicated at the time of registration. Space is limited. In the event that Le Monde is forced to cancel or postpone an Atelier or all or part of a series of Ateliers due to an event beyond its control (unavailability of the speaker, force majeure, terrorist threat, etc.), Le Monde shall inform the Clients concerned as soon as possible. Le Monde will propose new dates to the Customer as soon as possible. If the Customer can provide proof of a legitimate reason that prevents them from participating in the Atelier or in all or part of the series of Ateliers on the new dates proposed, they may request reimbursement of the price paid in proportion to the Ateliers they will be able to attend. No compensation other than the total or partial refund of the price paid will be owed by Le Monde to the Customer. No such refund shall be due in the context of a “Le Monde Ateliers” subscription offer. Ateliers that take place online or are made available online may be accessed following payment via a dedicated platform hosted on the ateliers.lemonde.fr website.The Customer may access video recordings of Ateliers or Ateliers courses on their account, or from the website homepage in the “Mes réservations” section. Video recordings are available to view on the ateliers.lemonde.fr website for a period of one year starting from the date of registration for an Atelier or Ateliers course, unless otherwise stipulated in the special conditions of sale. Should the online viewing services become temporarily unavailable, for whatever reason, Le Monde shall not be liable to the customer for any compensation. e. Le Monde subscriber events LE MONDE ÉVÉNEMENTS is a service that provides free or paid access either to the entirety or to part of an event (festival, fair, talk, etc.) (hereinafter referred to as an “Event”), organized or co-organized by Le Monde.  Events and the Specific Terms governing each event (dates, program, terms of entry, prizes, etc.) are listed on the dedicated website evenements.lemonde.fr (hereinafter “the Site LE MONDE ÉVÉNEMENTS”). Reservations may only be made online and are subject to availability. Reservation requests are processed on a first-come, first-served basis and Customers may be placed on a waiting list, where applicable.  A reservation to attend an Event, either in its entirety or in part, may be made: <ul> <li dir="ltr"> Upon logging in to an online account, if the Customer already has one. </li> <li dir="ltr"> Upon creating an online account. </li> <li dir="ltr"> As a guest, with no requirement to create an account. </li> </ul> Payments for paying Events are made online via a secure platform. All reservations made on the Site LE MONDE ÉVÉNEMENTS are confirmed by an email that is sent to the Customer.  Reservations are personal and may not be transferred, whether this be free of charge or in exchange for a fee. Access to an Event is dependent upon the presentation of a ticket and/or the reservation confirmation email and/or an identity document. If the reservation is made for a third party, the Customer must ensure that the individual concerned fulfils the terms of entry and agrees to the use of their personal data by LE MONDE ÉVÉNEMENTS within this context (with particular regard to the sending of confirmation and invitation emails). Unused reservations for paying Events may not be refunded. Customers may not cancel their reservation unless there are compelling reasons for doing so, as determined at Le Monde’s discretion. Le Monde reserves the right to cancel an Event for any legitimate reason beyond its control. In such cases, Le Monde shall not be liable to pay the Customer any damages other than a refund of the paid reservation fee, where applicable. No such refund shall be due if the Event is free of charge. In cases where Le Monde and/or the co-organizer, where applicable, is forced to cancel or postpone an Event, either in its entirety or in part, due to circumstances beyond their control (e.g., force majeure, weather event, unavailability of speakers, health or terrorist threat, etc.), Le Monde shall notify the Customers concerned at the earliest opportunity. Le Monde will strive to propose, in a timely manner, one or more rescheduled dates to the Customer. If the Customer can prove a legitimate reason preventing them from attending the Event at a newly proposed date, the Customer may, where applicable, request a refund of the fee paid for their attendance. Le Monde shall not be liable to the Customer for any damages other than this total or partial refund of the paid reservation fee, where applicable. No such refund shall be due if the Event is free of charge. <blockquote> f. Le Monde événements abonnés </blockquote> Part of the LE MONDE ÉVÉNEMENTS department, Le Monde subscriber events is a service reserved, under certain conditions, for all or some of the Customers and/or Beneficiaries who have a digital Subscription or a mixed Subscription to Le Monde. This service enables the Customer and/or Beneficiary to get free invitations to cultural events or Events organized or co-organized by Le Monde, subject to availability. To take advantage of this service, the Customer and/or Beneficiary must log in to their Account and select the event they wish to attend. Registration requests are processed in the order in which they are received and based on the number of events in which the Customer and/or Beneficiary has already participated. The Customer and/or Beneficiary's request will be answered by email. In the event that their request cannot be fulfilled, the Customer and/or Beneficiary may sign up on the waiting list to be informed if invitations become available again (additional spaces, cancellations). If the Customer and/or Beneficiary's request is accepted, the invitation is reserved in their name. Le Monde will inform the Customer and/or Beneficiary about how to access the invitations that have been granted. Should the Customer and/or Beneficiary be unable to attend, they are asked to cancel their reservation on their Account as soon as possible, so that another Customer and/or Beneficiary can go in their stead. Unless otherwise stated, the invitation is valid for two people, e.g. the Customer and/or Beneficiary and a guest of their choice. Invitations are personal and only authorized for use by the named individual. They are not transferable, either free of charge or for a fee. Spaces may not be reserved for a third party, with the exception, where applicable, of the person invited by and accompanying the Customer and/or Beneficiary. Invitations are to be picked up at the ticket office of the venue where the event takes place. As an exception, some invitations may be sent directly and free of charge to the Customer and/or Beneficiary by email or by mail to the address given by the Customer and/or Beneficiary. Le Monde cannot guarantee that scheduled events will take place. Should an event be cancelled (whether on decision by the organizer, terrorist threat, force majeure, etc.), Le Monde will inform the Customer and/or Beneficiary concerned as soon as possible. If an event is cancelled, Le Monde shall not owe the Customer and/or Beneficiary any compensation. If the event is postponed, Le Monde will offer any available places to the Customers and/or Beneficiaries who registered for the original event first. Unused or cancelled invitations may not used be exchanged for their monetary value or refunded in part or in full. <blockquote> g. Le Monde in English </blockquote> Le Monde in English is an online general-interest news service published by Le Monde and accessible at the web address <a href="www.lemonde.fr/en" target="_blank"> www.lemonde.fr/en</a>. This service is an integral part of the Website and its use is subject to these Terms and Conditions. It consists of a selection of editorial content from the Website, translated into English, and specific Products and/or Services. Some Content, Products and/or Services of Le Monde in English may be provided to the User and/or Customer and/or Beneficiary free of charge by Le Monde in English. Their access may be subject to the creation of an Account. A wider selection of content, Products and/or Services is only available to Customers and/or Beneficiaries with certain Subscription packages as specified in the Special Conditions. In the case of Editorial Content on the Website translated into English, only the original version in French of the translated Editorial Content offered by Le Monde in English can be relied upon and shall be held liable. <a href="#top" style="float: right;"> Return to the table of contents</a>   <a id="ancre_commandes"></a>IV. ORDERS FOR PRODUCTS AND/OR SERVICES Orders by professionals and legal entities are formalised by signing an Order Form upon contacting the Customer Service Department by email at <a href="pronumerique@lemonde.fr" target="_blank"> pronumerique@lemonde.fr</a> or by mail at Monde Service abonnements A3000 62067 Arras cedex 9. Orders by individuals may be placed: <blockquote> - Online on the Website and/or Applications In this case, it is necessary to create or have an Account and to be logged in with your access codes. After placing articles in their cart, the User and/or Customer must complete all the information provided in the form: contact details, delivery and billing address(es), payment method, etc. The User and/or Customer must then expressly accept the General Terms and Conditions after having read them and confirmed the Order form. The Customer’s Order shall then be considered firm. In case of suspicion of technical issues having prevented the finalization of the order, Le Monde may contact the Customer in order to offer technical support, without this obliging in any way the Customer to finalize their order. - By telephone, email or mail sent to our Customer Service department . The contact information for Customer Service is provided in <a href="#ancre_client" target="_parent">article XIV</a> hereof. </blockquote> Orders may only be placed for offers in effect on the date of their registration, including promotional offers. Orders may only concern the offers that are available in the geographical area the order is placed from. Le Monde may refuse or cancel any Order that does not meet the conditions of the offer as mentioned in the Special Conditions, or in case of unavailability of a Product and/or Service. Le Monde also reserves the right to suspend, refuse or cancel any Order from a Customer with whom there is any payment dispute, without this cancellation giving rise, on any grounds whatsoever, to any compensation. All accepted Orders shall be confirmed in writing by Le Monde to the Customer by displaying an information page on the Internet webpage, followed by an email, or, if no email address is provided, by mail. This confirmation contains the contractual information (products ordered, price, delivery address, shipping costs, etc.). It also provides access to the applicable <a href="http://wpm.ccmp.eu/wpm/100083/cgv_sem/cgv-sem.pdf" target="_blank">General Terms and Conditions on a durable medium.</a>. This Order confirmation of Order constitutes acceptance of the order by Le Monde and confirms the transaction. We recommend that the Customer save a copy of this confirmation. The information relating to the transaction can also be consulted by the Customer in their Account. If a Product is ordered by telephone or mail, a delivery note confirming the Order will be attached to said Product. In the event that the payment of the Order is not simultaneous with the Order, the Contract shall not be deemed concluded until the payment is received. The data recorded by Le Monde and/or its service providers, within the framework of the execution of the Contract, constitute the proof of all the transactions between Le Monde and its Customers (subscription offer, subscription date). In particular, the data recorded by the payment system constitutes proof of the financial transactions. - For subscriptions via third-party merchant platforms: Any transaction enabling a subscription to be placed on a third-party digital merchant platform (such as Apple Store, Google Play or any other Le Monde partner platform), is deemed as having been agreed between the Customer and the platform operator. The amount the Customer must pay is charged by the operator in question. Customers can manage and cancel their subscriptions by accessing their account settings on these platforms. Use of the Products and Services provided by Le Monde accessed via subscription is subject to these General Terms and Conditions. <a href="#top" style="float: right;"> Return to the table of contents</a>   <a id="ancre_tarifs"></a>V. PRICES <blockquote> a. Prices applicable at the time of the Order </blockquote> Prices that apply to professionals or legal entities are negotiated by mutual agreement and formalized when the Order Form is signed. The prices of Le Monde's Products and/or Services for individuals are those in force on the date of the Order. They are mentioned in the Special Conditions and indicated before any subscription or one-time purchase. They are indicated in euros, including all taxes. Any shipping costs that may apply to the order are indicated and applied before the order is confirmed and paid for by the Customer. If one or more taxes or contributions are created or modified, this change may be reflected in the price of Sale of the Products and/or Services presented on the various sales media. All Orders, regardless of the Customer’s country of residence or of delivery, shall be paid in euros. Le Monde reserves the right to modify the prices of the Products and/or Services throughout the entire duration they are offered for sale, in compliance with the regulations in force. It may also decide on a one-time promotional operation. The prices applicable to an Order are those in effect on the date of the Order as stated in the subscription form. Under no circumstances shall price changes or promotions of Product and/or Service subsequent to the date of the Order give rise to a claim or cancellation thereof by the Customer. Promotional offers are only available for a limited time and are subject to conditions. They are not cumulative. They cannot be exchanged for their monetary value or refunded in part or in full. If the Customer has a code that could give them an advantage or a promotional rate on Products and/or Services of Le Monde, it must be entered at the time of subscription. This code can only be used once during its validity period. It is personal and non-transferable. Due to the unique and conditional nature of each promotional offer, Le Monde reserves the right, if it finds that a User and/or Customer has subscribed to a promotional offer they have already benefited from or for which they do not meet the conditions, to apply the normal price in force instead of the promotional price. All Orders, regardless of whether the Customer is a private individual, a professional or a legal entity, and whatever the country of domicile or delivery, shall be paid in euros. If one or more taxes or contributions are created or modified, this change may be reflected in the selling price of the Products and/or Services displayed on the various sales media. <blockquote> b. Changes to in-progress Subscription Contract prices </blockquote> Le Monde may revise the prices of in-progress Subscription Contracts under the following conditions: <blockquote> - For a contract with professionals and/or legal entities: The price is guaranteed for the entire contract period currently underway. - For a subscription contract taken out for a fixed duration: The price is guaranteed for the entire current duration of the commitment. - For an open-ended subscription contract: The price may not be changed for one year, unless increments were already provided for the first year and agreed to when the Order was placed. </blockquote> Except for increases that were already set out at the time of the Order, Le Monde must notify the Customer of any price increase that was not set out when the Order was placed at least one month before it comes into effect. The Customer may freely cancel their subscription upon receiving such a notification. Failure to terminate the subscription within the specified time period will result in the price change being deemed accepted and will apply to the continuation of the Contract. <a href="#top" style="float: right;"> Return to the table of contents</a>   <a id="ancre_paiement"></a>VI. PAYMENT Except for a specific clause in the Special Conditions or in an Order Form, Products and/or Services sold by Le Monde may be paid for: <blockquote> By credit card: Debit card, Visa, MasterCard, American Express, Eurocard and Visa International Online payment by one of the accepted credit cards is provided through the secured solution the epayment secured solution - Worldline, which uses SSL (Secure Socket Layer) encryption. The SSL (Secure Socket Layer) protocol guarantees the confidentiality of the payment information that is sent. The «https» the website address and the padlock icon next to the address bar are the sign of the security and confidentiality of the payment. Le Monde does not store the full credit card number on its servers. Credit card numbers are processed by Sips - Worldline and transactions with Le Monde are based on authorization numbers, transaction numbers and merchant identifiers. The Customer’s credit card details are never sent unencrypted over the network. The card is debited immediately, including in the case of Products not immediately available or pre-ordered, unless otherwise stated in the applicable Special Conditions. In the case of a subscription with direct debit payments, it is the responsibility of the Customer whose card is no longer valid to either - update their payment information by logging into their Account on the Le Monde website - otherwise, to contact Customer Service and provide new payment information. Failure to do so will result in the suspension of the subscription. By SEPA direct debit </blockquote> When taking out a subscription, the Customer may: <blockquote> - Send a duly completed SEPA direct debit form by mail, along with with a bank identification statement (RIB) to the Customer Service department, at the mailing address indicated on the form or IN <a href="#ancre_client" target="_parent">article XIV</a> of this document. - OR sign the mandate via the secure online solution. This mandate is identified by a «Unique Mandate Reference» (RUM). </blockquote> The Customer agrees to provide accurate and complete bank information when signing up for a subscription using direct debit and signing a mandate. Should this information change, the Customer shall either: <blockquote>- update their information by signing into their Account on the Le Monde Website - contact Customer Service.</blockquote> Any revocation of the SEPA direct debit mandate will result in the termination of the Subscription Contract. The first SEPA direct debit, notified in the Order confirmation, will be made as soon as the subscription is set up, unless otherwise specified in the applicable Special Conditions. <blockquote> By PayPal </blockquote> Payment via PayPal shall be in accordance with the latter's terms and conditions, which we encourage you to view: <a href="https://www.paypal.com/us/legalhub/useragreement-full">https://www.paypal.com/us/legalhub/useragreement-full</a>  <blockquote> By check </blockquote> Customers may pay for their purchases in the Shop by check. Payment by check for online subscriptions and renewals is not possible. The check must be issued by a bank domiciled in metropolitan France and made out to the “Société éditrice du Monde”. The Customer must send the check, along with the Order or subscription form, to the Customer Service department, at the mailing address indicated in Article XIV of this document. The check will be cashed upon receipt by Le Monde. The Order lay only be delivered after Le Monde has cashed the check. In the event of a payment incident, the execution of the Order will be suspended. If payment is not received within a maximum of fifteen days from the date the Order is placed, Le Monde shall have the right to cancel the Order, without prejudice to its right to demand payment of its debt for the period that has elapsed. The Customer acknowledges that they must pay the full price of the Products and/or Services purchased and the related costs. For an ongoing subscription contract, in the event of repeated non-payment by a Customer, whatever the method of payment chosen, and following reminders from Le Monde that have been ignored, Le Monde reserves the right to terminate the contract, and to refuse any subsequent subscription. The Customer may submit any complaint or dispute concerning the invoice to Customer Service. <a href="#top" style="float: right;"> Return to the table of contents</a>   <a id="ancre_livraison"></a>VII. DELIVERY <blockquote> 1. Delivery of printed press publications as part of a subscription </blockquote> - Unless otherwise stated in the Special Conditions or the Order Form, the cost of delivering printed versions of press publications published by Le Monde in mainland France and Monaco is included in the subscription price. - Subscriptions with a delivery address that is not located in metropolitan France or Monaco can only be taken out through the Customer Service department, which will calculate the applicable delivery charges on a case-by-case basis, in addition to the subscription price. - The printed press publications the Customer subscribes to shall be delivered to the Customer, at the frequency specified in the Contract, at the address specified in the Order. It is the Customer’s responsibility to provide clear, accurate and complete information so that the Order can be correctly delivered. If subscribing on behalf of a Beneficiary, the Customer must inform the Beneficiary beforehand that they will be giving Le Monde the personal data necessary for delivering the publications. - The Customer agrees to inform Le Monde without delay of any change of address or other information required to deliver the publications (e.g. change of access code to a building) by contacting Customer Service or by signing into their online account. - Unless otherwise specified, issues of the paper publication the Customer has subscribed to shall begin within an average of one week for Le Monde and three weeks for the Weekly Selection after confirming their Order. If the issues are not received within this period, the Customer should contact Customer Service. - It is possible to have the publication delivered to another address during vacation or a temporary absence. The request must be made at least ten working days in advance. - It is also possible to temporarily suspend the delivery of Le Monde for a maximum of twelve weeks, consecutive or not, per period of twelve consecutive months. The a request must be made at least seven working days in advance through the Customer’s Account or the Customer Service department. - If the temporarily suspended Contract is subscribed for a fixed term and is paid in advance, its term is extended by a time equal to the length of the suspension. - In the case of an open-ended contract paid with direct debit, the issues corresponding to the suspension period are deducted from the corresponding direct debit. - Requests for suspension or a temporary change of delivery address can be made through the Customer’s Account or the Customer Service department. - Depending on the geographical area of the delivery address, the publication will be delivered either by La Poste or by a home delivery service. The times of delivery are those usually observed by the postal service or the delivery service providers. In the event of a one-time or repeated delivery issue, the Customer must notify Customer Service as soon as possible so that the cause of the incident can be investigated and corrected by the service provider concerned. <blockquote> 2. Delivery of Products ordered in the Shop - Product Returns </blockquote> - Products ordered in the Shop can only be shipped to metropolitan France and Monaco. - They are delivered by mail using Coliéco or Colissimo. - Le Monde undertakes to deliver the Products to the Customer at the address indicated. The average delivery time for available Products is three weeks. - When an Order includes several Products with different availability dates, the shipping date of the Products is based on the latest availability date. However, Le Monde reserves the right to split shipments. In this case, the Customer will only be charged once for the shipping fees - The Products are delivered to the delivery address indicated by the Customer when the Order is placed. It is the Customer’s responsibility to provide clear, accurate and complete information so that the Order can be correctly executed. - Le Monde cannot be held responsible for any damages resulting from a Customer error in the information provided (product loss, delayed delivery, etc.). Any costs resulting from such an error shall be borne exclusively by the Customer. - If the Customer or Beneficiary is not present at the address indicated in their order on the scheduled delivery date, a delivery notice will be left in their mailbox. It is the Customer or Beneficiary’s responsibility to pick up the package from the postal service, under the conditions indicated on the delivery notice. - If the package is not picked up by the Customer or Beneficiary within the time limit, it will be sent back to Le Monde by the post office. - In this case, the Customer may request either the cancellation of the Order and a refund of the amount of the Order (excluding shipping costs), or to have the Product shipped again at their own expense. - After thirty days from the date of the Order, if the Product has not been delivered, the sale may be terminated at the request of either party. The Customer shall be reimbursed the amount of the Order, the shipping costs being borne by the Customer, to the exclusion of any compensation. - Notwithstanding the right of withdrawal, the Customer has the option of returning a Product that is not satisfactory within thirty days of receipt. It must be returned complete in its original packaging. For CDs and DVDs, the blister packaging must not have been opened. Products that are returned incomplete, damaged or dirty will not be returned or refunded. However, the Customer shall not be held liable for any depreciation of the Products due to handling required to establish the nature, characteristics and proper functioning of the Product. The Product must be sent along with the stub at the bottom of the invoice or delivery note, to the following address: Tessi - Retour produit Le Monde - 490 rue des Frênes - 45700 Pannes, France. The cost of the return is the Customer’s responsibility. The Customer shall also bear the risks associated with the return. If the Product is lost or damaged, the Customer shall be solely responsible and the Product shall not be refunded by Le Monde. Le Monde will reimburse the purchase price of the Product, except for the shipping costs. If the Product was purchased by credit or debit card, the refund will be made by crediting the card within an average of ten working days. If another method of payment was used, the Customer shall be asked to provide a bank identification statement (RIB) so that Le Monde can refund the purchase price by bank transfer within an average of four to six weeks. Le Monde reserves the right to postpone the refund until the Product is recovered and/or to refuse the return if the product is returned incomplete, damaged or dirty. Finally, in the case of an Order paid for by check, Le Monde reserves the right to ensure that the check has cleared before issuing a refund to the Customer. <a href="#top" style="float: right;"> Return to the table of contents</a>   <a id="ancre_engagement"></a>VIII. DURATION OF THE COMMITMENT - TERMINATION <blockquote> 1. Duration of the Commitment </blockquote> Subscription Offers for Le Monde's Products and/or Services are subscribed to for the duration indicated in the Special Conditions and/or the applicable subscription form and/or the Order Form. This duration may be: <ul> <li>Open-ended:</li> </ul> <blockquote> In this case, the subscription, with an initial duration of one month, is automatically and tacitly renewed for successive periods of an equivalent duration. The Customer their subscription every month by direct debit and has the right, to cancel it at any time and for any reason. Unless otherwise specified, the termination will be effective at the end of the current month. In the event of a price change that is not mentioned in the Specific Conditions of the offer when the subscription is taken out, Le Monde will inform the Customer in writing with a minimum of one month’s notice before the next contractual deadline. The Customer will be able to terminate their subscription before this date. Otherwise, the subscription will continue with the new applicable price. </blockquote> <ul> <li>Fixed-Term:</li> </ul> <blockquote> In this case, the subscription is taken out for a fixed period and cannot be terminated during the course of the contract, unless otherwise stipulated by law. The subscription price is payable on receipt. It is a lump-sum payment and is not refundable. Exceptionally, Le Monde may, at its own discretion, accept a request for early termination of a Fixed-term Contract begun by an individual in the event of serious and duly proven individual circumstances. At its expiration, unless otherwise stipulated in the Special Conditions, a Fixed-Term subscription shall not be renewed without the explicit agreement of the Customer. The customer will be asked by Le Monde to resubscribe. Depending on the applicable Special Conditions or Order Form, the subscription may be tacitly renewed at the rate in force on the renewal date, or require the customer's explicit agreement to be renewed. The customer will then be asked by Le Monde to resubscribe. 2. [www.lemonde.fr] <ul> <li dir="ltr"> or according to the terms set by any other cancellation legal framework. </li> </ul> Cancellation shall be effective from the end date of the current contract. <blockquote> 3. Termination by Le Monde </blockquote> Le Monde may terminate a Contract automatically and without notice in the event of non-compliance with its policies by the Customer or the Beneficiary, without prejudice to any action that Le Monde may decide to take against the latter, particularly if there have been unpaid services. Le Monde also reserves the right to terminate the Contract if it is found that the intended service cannot be provided (e.g. delivery address not serviced by postal or courier services; delivery address not covered by a telecommunications network capable of providing an online service). In this case, Le Monde undertakes to reimburse the Customer for services paid for but not rendered. This termination does not constitute a prejudice giving right to any compensation from Le Monde. <a href="#top" style="float: right;"> Return to the table of contents</a>   <a id="ancre_retractation"></a>IX. RIGHT OF WITHDRAWAL In accordance with articles L. 221-18 et seq. of the French Consumer Code, the Customer, who may be qualified as a consumer in the sense of the applicable law, has a right of withdrawal that allows them to request a refund for an Order placed remotely (online or by telephone). However, the right of withdrawal cannot be exercised, in particular, for the following Products and/or Services: <blockquote>- Newspapers, periodicals or magazines, except in the case of a paper subscription Contract. - Digital content provided on an intangible medium and a subscription contract for these services for which performance has begun with the Customer’s agreement and for which the Customer has waived their right of withdrawal. - CDs, DVDs or books whose blister packaging has been opened by the Customer. - Services that have been fully performed before the end of the withdrawal period and whose performance has started with the Customer’s agreement or at their express request. A service shall be considered to have been performed if the Customer has made a reservation but has not taken advantage of the service, without cancellation. - Goods that are inseparable from other items (e.g. the supplement to a publication). - Goods made at the request of the Customer or which are significantly personalized.</blockquote> <blockquote>- Reservations for fixed-date leisure activities.</blockquote> The right of withdrawal must be exercised within fourteen days of: <blockquote>- Receipt of the Order in the case of delivery of tangible movable goods. - The signature of the Contract as part of a subscription to an electronic publication or service. - Receipt of the first issue in the case of a subscription to a paper publication.</blockquote> If this time limit would normally expire on a Saturday, Sunday or a holiday or non-working day, it is extended to the next following working day. The Customer does not have to give reasons or justification for their decision. No penalty will be claimed in case of withdrawal. The Customer must inform Le Monde of their decision to exercise their right to withdrawal by printing out and completing the following standard withdrawal form: - For paper or mixed (paper + digital) subscribers, <a href="https://asset.lemde.fr/abo/forms/Formulaire_Retraction_Abonnement_Papier.pdf" target="_blank">click here</a> - For digital subscribers, <a href="https://asset.lemde.fr/abo/forms/Formulaire_Retractation_Abonnement_Numerique.pdf" target="_blank">click here</a> They may also send any other written request that unambiguously expresses their desire to exercise their right to withdrawal. The request, accompanied by a statement of their bank details, must be sent, before the expiration of the fourteen (14) day period mentioned above, to the Customer Service, whose contact information is provided in Article XIV. For Le Monde Mémorable, the form can be sent by email to the following address: <a href="mailto:memorable@gymglish.com">memorable@gymglish.com</a>. Where the right of withdrawal relates to the purchase of a tangible good, the mere return of the goods or the Customer’s refusal to accept delivery of them are not sufficient to express the Customer’s wish exercise their right of withdrawal. Upon receipt of the withdrawal form, Le Monde will send the Customer acknowledgement of receipt. In case of withdrawal after purchase of a tangible good, the Product must be returned, without unreasonable delay and at the latest before the end of the fourteen (14) day period following the Customer’s notification of their decision to withdraw, sent to the following address: Tessi - Retour produit Le Monde - 490 rue des Frênes - 45700 Pannes, France. In case of withdrawal from a Contract with a gift, the gift must be returned, without unreasonable delay and at the latest before the end of the fourteen (14) day period following the Customer’s notification of their decision to withdraw, sent to the same address. The cost of the returned Product and/or gift is the Customer’s responsibility. The Product and/or the gift must be returned complete and in its original condition. The Product must be sent along with the a copy of the invoice or delivery note. The cost of the returned Product and/or gift, for whatever reason, is the Customer’s responsibility. If the Product and/or the gift is lost or damaged during shipping, the Customer will be solely responsible. The Product cannot be refunded by Le Monde. The refund of the amount paid by the Customer and collected by Le Monde will be made within a period less than or equal to fourteen (14) days after the receipt of the request, by transfer to the Customer’s bank account. The costs corresponding to the initial shipment will also be refunded, with the exception of additional costs linked to the choice by the Customer of a more expensive delivery method than the standard delivery method proposed by Le Monde. In case of withdrawal after purchase of a Service, the price is refunded, minus an amount corresponding to the Services already provided before the decision to withdraw, when these have been provided with the express consent of the Customer. In the event of withdrawal after the purchase of a subscription to a periodical press publication, the price of the subscription will be refunded, minus the Product(s) already delivered. In the event of withdrawal after the purchase of tangible goods, Le Monde reserves the right to delay the refund until the goods have been returned and/or to refuse to issue the refund if the goods are returned incomplete, damaged or dirty. In accordance with the provisions of Article L. 221-23 of the French Consumer Code, the consumer’s liability may only be incurred in the event of depreciation of the goods resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of these goods. Finally, in the case of withdrawal for an Order paid for by check, Le Monde reserves the right to ensure that the check has cleared before issuing a refund to the Customer. <a href="#top" style="float: right;"> Return to the table of contents </a>   <a id="ancre_garanties"></a>X. CONFORMITY OF THE PRODUCTS - LEGAL GUARANTEES The following legal provisions apply to any sale by Le Monde to a consumer, within the meaning of the applicable legislation, of tangible movable goods. They provide the consumer to take advantage of the legal guarantee of conformity (Article L. 217-1 et seq. of the French Consumer Code) and the guarantee against hidden defects (Article 1641 et seq. of the French Civil Code) by returning the Products that were delivered defective or non-conforming to Le Monde. <blockquote> 1. Legal guarantee of conformity </blockquote> Under Article L. 217- 4 of the French Consumer Code, «The seller shall deliver goods in conformity with the contract and shall be liable for any lack of conformity existing at the time of delivery. He shall also be liable for non-conformity resulting from the packaging, the assembly instructions or the installation when this was made his responsibility in the contract or was carried out under his responsibility ”. Under Article L. 217-5 of the French Consumer Code, “a good is in conformity with the contract if : <blockquote> - whether it is fit for the purpose that can usually be expected of similar goods and, if so; - if it corresponds to the description provided by the seller and has the qualities that the seller has presented to the buyer in the form of samples or a model; - whether it has the qualities that a purchaser may legitimately expect, having regard to the public statements made by the seller, the producer, or his representative, in particular advertising or labelling; - if it has the characteristics defined by mutual agreement between the parties or is fit for any special purpose sought by the buyer, that is brought to the seller’s attention and accepted by the latter."". </blockquote> Under Article L. 217-7 of the French Consumer Code, «Defects of conformity which appear within twenty-four months of delivery of the goods shall be presumed to have existed at the time of delivery, unless proven otherwise. The seller may rebut this presumption if it is not compatible with the nature of the goods or the lack of conformity claimed. ” Under Article L. 217-10 of the French Consumer Code, « If repair and replacement of the goods are impossible, the buyer may return the goods and be refunded the purchase price or keep the goods and have part of the purchase price refunded . The same option is available: <blockquote> 1 - if the solution requested, proposed, or agreed on pursuant to Article L. 217-9 cannot be implemented within one month of the buyer’s claim; 2 - or if this solution cannot be achieved without major inconvenience to the buyer, given the nature of the goods and the use he is seeking. However, the sale cannot be rescinded if the non-conformity is minor". </blockquote> Under Article L. 217-12 of the French Consumer Code, "Legal action for non-conformity must be brought within two years from the delivery of the goods. " <blockquote> 2. Legal guarantee against hidden defects </blockquote> Under Article 1641 of the French Civil Code: " The seller is liable for hidden defects in the item sold that make it unfit for the purpose for which it was intended, or that so reduce that purpose that the buyer would not have purchased it, or would have offered a lower price for it, if he had known about them. ” Under Article 1645 of the French Civil Code: " If the seller was aware of the defects in the item, he shall be liable, in addition to refunding the monies, for all damages to the buyer.” Under Article 1646 of the French Civil Code: " If the seller was unaware of the defects in the item, he shall be liable only to refund the purchase the price and to reimburse the buyer for the costs incurred by the sale.” Under Article 1648 of the French Civil Code: "Legal action due to unacceptable defects must be brought by the purchaser within two years of the discovery of the defect. In the case provided for under Article 1642-1, the legal action must be brought, on pain of forfeiture, within one year from the date on which the seller may no longer be liable for the defects or apparent non-conformity.” <blockquote> 3. Specific provisions relating to the supply of digital content and services (Articles L.224- 25-1 et seq. of the Cconsumer Code) </blockquote> In accordance with Articles L. 224-25-12 and the French Consumer Code, Le Monde provides a legal guarantee of the compliance of digital content and services sold on the Website and the Applications (hereinafter referred to as ‘’Digital Content and Services’’). When implementing the legal guarantee of compliance, the Customer benefits in the event of a one-off supply or a series of separate supply operations of Digital Content and/or Services, within a period of two (2) years of supply to act.Any lack of compliance that arises within a period of twelve (12) months of supply of Digital Content and Services are presumed to have existed at the time of supply. In the event that Digital Content and Services are provided on a continuous basis, the User may take action during the entire period during which it is provided. The burden of proof with respect to compliance of the Digital Content and Services during the contractual period of supply lies with Le Monde in the case of lack of compliance during said period. The Customer is entitled to have the digital content or service brought into compliance or, failing that, to have the price reduced or the contract rescinded, under the conditions set out in Articles L. 224-25-17 to L. 224-25-23 of the Customer Code. The Customer has the right to suspend payment of all or a part of the fee until Le Monde has ensured compliance with the Digital Content and Services. The compliance shall take place at no cost to the Customer, without any unjustified delay following the Customer’s request and without any major inconvenience to the Customer, taking into account the nature and the use of the Digital Content and Service sought by the Customer. Le Monde may refuse, provided if written justification is given, to ensure compliance with Digital Content and Services if it proves impossible or entails disproportionate costs, particularly with regards to the extent of the lack of compliance and the value of the Digital Content and Service in the absence of the defect. In the event that Le Monde does not respect these conditions, the Customer may, after giving formal notice, proceed with enforcement of the requested compliance. Le Monde shall proceed with the reimbursement of any sums due to the customer without undue delay, and, at the latest, within fourteen (14) days following the decision of the Customer to assert his or her right to a price reduction or the cancellation of a contract. Unless the Customer expressly agrees otherwise and provided no additional costs are incurred, Le Monde will make the refund using the same means of payment as that used by the Customer when purchasing the Product or Service. When the Customer requests for compliance covered by the guarantee, any shutdown or non-available period of the Digital Service and Content suspends the guarantee until it is brought back into compliance. The legal guarantee of compliance provided by Le Monde applies independently to any commercial guarantee that may have been granted. The Digital Content and Services benefit from legal guarantees provided that they are used normally and that the necessary instructions have been followed. Any guarantee is invalid in the case of misuse, non-compliant repair or modification, negligence or lack of upkeep by the User, as with normal wear and tear or force majeure. <blockquote> 4.
