Constant Gardener,” starring Rachel Weisz and based on the book by John le Carre, which was reportedly inspired by the Pfizer case.</em></p> <p>In 1996, Pfizer conducted a clinical trial of Trovan, a new antibiotic, on children during an outbreak of bacterial meningitis in Kano, Nigeria. Eleven children died and others were left badly injured, according to trial participants. In 2001, 30 Nigerian families sued in U.S. federal court, arguing that Pfizer deviated from its clinical trial protocol and failed to inform the children or their guardians of Trovan’s life-threatening side effects or that Médecins Sans Frontières was providing the conventional, proven treatment for bacterial meningitis for free at the same site. Pfizer has denied wrongdoing. Years of litigation followed over whether the case should be heard in U.S. courts. Earlier this year, a <a href="https://web.archive.org/web/20090903100819/http://caselaw.lp.findlaw.com/data2/circs/2nd/054863p.pdf">U.S. appeals court ruled</a> that the <em>Pfizer</em> case could proceed.</p> <p>The U.S. Supreme Court is now deciding whether to hear the <em>Pfizer</em> case. If the Court hears the case, and there is a good chance it will, the Court will be asked to decide two important questions: (1) whether Pfizer acted in sufficiently close concert with the Nigerian government to be considered a “state actor” and, thus, possibly liable under the <a href="https://web.archive.org/web/20090903100819/http://law.justia.com/us/codes/title28/28usc1350.html">U.S. Alien Tort Statute (ATS)</a> and (2) whether nonconsensual human medical experimentation violates customary international law. These questions sound pretty technical, but the Court’s answers could have significant practical implications for corporate responsibility, development, and global health. <a href="https://web.archive.org/web/20090903100819/http://blogs.cgdev.org/globalhealth/2009/08/potential-us-supreme-court-case-on-nigerian-drug-trial-presents-mixed-picture-for-global-health.php#more-1297" class="more-link">More&#8230;</a></p> </p> <p class="posted"><a href="https://web.archive.org/web/20090903100819/http://blogs.cgdev.org/globalhealth/2009/08/potential-us-supreme-court-case-on-nigerian-drug-trial-presents-mixed-picture-for-global-health.php#comments" title="Comment on Potential U.S. Supreme Court Case on Nigerian Drug Trial Presents Mixed Picture for Global Health">6 Comments</a></p> </div> <div class="br"><br/></div> <div id="post-1288"> <h2> August 27, 2009 </h2> <h3><a href="https://web.archive.org/web/20090903100819/http://blogs.cgdev.org/globalhealth/2009/08/a-bad-choice-between-your-stomach-and-your-health.php" rel="bookmark" title="Permanent Link to A Bad Choice between Your Stomach and Your Health">A Bad Choice between Your Stomach and Your Health</a></h3> <h4>By <a href="https://web.archive.org/web/20090903100819/http://blogs.cgdev.org/globalhealth/author/rachel-nugent/" title="Posts by Rachel Nugent">Rachel Nugent</a> </h4> <p><p><em><a href="https://web.archive.org/web/20090903100819/http://www.cgdev.org/section/about/staff#PShar">Priya Sharma</a> provided research assistance in the development of this blog.</em></p> <p>A <a href="https://web.archive.org/web/20090903100819/http://www.nytimes.com/2009/07/24/opinion/24fr3.html">New York Times editorial</a> from a few weeks back caught my eye because of the link to drug resistance, and that of my colleague, Kim Elliott, who specializes in agriculture trade policy. What concerns could we possibly have in common, Kim and I? You guessed it: antibiotic use in animal-based food production. To quote Kim, “It makes no sense whatsoever!” Kim is right, and anyone who looks at this situation for even a few seconds can easily see that. <a href="https://web.archive.org/web/20090903100819/http://blogs.cgdev.org/globalhealth/2009/08/a-bad-choice-between-your-stomach-and-your-health.php#more-1288" class="more-link">More&#8230;</a></p> </p> <p class="posted"><a href="https://web.archive.org/web/20090903100819/http://blogs.cgdev.org/globalhealth/2009/08/a-bad-choice-between-your-stomach-and-your-health.php#respond" title="Comment on A Bad Choice between Your Stomach and Your Health">Comment</a></p> </div> <div class="br"><br/></div> <div id="post-1284"> <h2> August 24, 2009 </h2> <h3><a href="https://web.archive.org/web/20090903100819/http://blogs.cgdev.org/globalhealth/2009/08/reflections-on-nyt-magazine-special-issue-on-gender-three-questions-to-guide-the-new-crusade.php" rel="bookmark" title="Permanent Link to Reflections on NYT Magazine Special Issue on Gender: Three Questions to Guide the New Crusade">Reflections on NYT Magazine Special Issue on Gender: Three Questions to Guide the New Crusade</a></h3> <h4>By <a href="https://web.archive.org/web/20090903100819/http://blogs.cgdev.org/globalhealth/author/ruth-levine/" title="Posts by Ruth Levine">Ruth Levine</a> </h4> <p><p><em>This is a joint post with Molly Kinder and originally appeared on the <a href="https://web.archive.org/web/20090903100819/http://blogs.cgdev.org/globaldevelopment/2009/08/reflections-on-nyt-magazine-special-issue-on-gender-three-questions-to-guide-the-new-crusade.php">Global Development: Views from the Center</a> blog.</em></p> <p>This week <em>The New York Times Magazine</em> is dedicated to a single theme: women. The main attraction of this special issue is a stirring <a href="https://web.archive.org/web/20090903100819/http://www.nytimes.com/2009/08/23/magazine/23Women-t.html?em">essay</a> by journalists Nicholas Kristof and Sheryl WuDunn, who write passionately about the great moral, national security and economic development imperatives of investing in the world’s women and girls. The “women’s crusade” they call for seems already to have begun. A few pages beyond, an interview with Secretary Clinton heralds the start of a “new gender agenda” at the highest reaches of the U.S. foreign policy. Also noted is the growing philanthropic attention to the cause of women and girls – a trend that will be further evidenced next month, when the issue headlines at the annual (Bill) Clinton Global Initiative meetings in NYC. <a href="https://web.archive.org/web/20090903100819/http://blogs.cgdev.org/globalhealth/2009/08/reflections-on-nyt-magazine-special-issue-on-gender-three-questions-to-guide-the-new-crusade.php#more-1284" class="more-link">More&#8230;</a></p> </p> <p class="posted"><a href="https://web.archive.org/web/20090903100819/http://blogs.cgdev.org/globalhealth/2009/08/reflections-on-nyt-magazine-special-issue-on-gender-three-questions-to-guide-the-new-crusade.php#comments" title="Comment on Reflections on NYT Magazine Special Issue on Gender: Three Questions to Guide the New Crusade">3 Comments</a></p> </div> <div class="br"><br/></div> <div id="post-1279"> <h2> August 24, 2009 </h2> <h3><a href="https://web.archive.org/web/20090903100819/http://blogs.cgdev.org/globalhealth/2009/08/what-happens-when-you-combine-a-newspaper-with-a-ugandan-village-and-the-internet.php" rel="bookmark" title="Permanent Link to What Happens When You Combine a Newspaper with a Ugandan Village and the Internet?">What Happens When You Combine a Newspaper with a Ugandan Village and the Internet?</a></h3> <h4>By <a href="https://web.archive.org/web/20090903100819/http://blogs.cgdev.org/globalhealth/author/david-wendt/" title="Posts by David Wendt">David Wendt</a> </h4> <p><p>Compared to <a href="https://web.archive.org/web/20090903100819/http://www.studsterkel.org/">Studs Terkel</a> and <a href="https://web.archive.org/web/20090903100819/http://en.wikipedia.org/wiki/How_The_Other_Half_Lives">Jacob Riis</a>, who excelled in their use of popular communication as an instrument for progressive social change, I’m sure many of us who work in development often cringe when issues of poverty are “covered” by our usually schizophrenic, ratings driven news media. Terkel only had audio, and Riis only had images, yet they were able to make profound impacts on how people saw and interacted with the world, contributing to significant social and economic change. As for us, now there are all these new online technologies – video and audio streaming, interactive flash, wikis, and even twitter (for what it’s worth) – but what talent has emerged for using them within development? <a href="https://web.archive.org/web/20090903100819/http://blogs.cgdev.org/globalhealth/2009/08/what-happens-when-you-combine-a-newspaper-with-a-ugandan-village-and-the-internet.php#more-1279" class="more-link">More&#8230;</a></p> </p> <p class="posted"><a href="https://web.archive.org/web/20090903100819/http://blogs.cgdev.org/globalhealth/2009/08/what-happens-when-you-combine-a-newspaper-with-a-ugandan-village-and-the-internet.php#respond" title="Comment on What Happens When You Combine a Newspaper with a Ugandan Village and the Internet?">Comment</a></p> </div> <div class="br"><br/></div> <div id="post-1273"> <h2> August 20, 2009 </h2> <h3><a href="https://web.archive.org/web/20090903100819/http://blogs.cgdev.org/globalhealth/2009/08/a-promising-senate-initiative-on-neglected-diseases.php" rel="bookmark" title="Permanent Link to A Promising Senate Initiative on Neglected Diseases">A Promising Senate Initiative on Neglected Diseases</a></h3> <h4>By <a href="https://web.archive.org/web/20090903100819/http://blogs.cgdev.org/globalhealth/author/tbollyky/" title="Posts by Tom Bollyky">Tom Bollyky</a> </h4> <p><p>Early this month the U.S. Senate passed an amendment to pending legislation that has the potential to strengthen and streamline regulations governing the clinical testing of drugs for neglected diseases in the developing world. The targeted diseases include malaria and TB, which annually kill an estimated 2.5 million people in the developing world, plus scores of diseases you may have never heard of (such as Chagas disease and leishmaniasis), but that nonetheless exact a large and lethal toll, especially on children and poor people in developing countries.</p> <p>Senator Sam Brownback, a Republican from Kansas, introduced the amendment to the Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations Act of 2010. This paradox, although painful, is all too easy to imagine.</p> <p>Take HIV/AIDS. Since President Bush announced the <a href="https://web.archive.org/web/20090903100819/http://www.pepfar.gov/">President’s Emergency Plan for AIDS Relief</a> in the 2003 State of the Union Address, U.S. dollars have been put to work to get more than 2 million people started on antiretroviral treatment, most of them under the auspices of programs operated by U.S.-based contractors. PEPFAR has been hailed as a success, and can certainly claim credit for sparing many from certain death – at least while the ARVs are available and effective. <a href="https://web.archive.org/web/20090903100819/http://blogs.cgdev.org/globalhealth/2009/08/will-the-us-have-better-global-health-policies-but-get-worse-results.php#more-1262" class="more-link">More&#8230;</a></p> </p> <p class="posted"><a href="https://web.archive.org/web/20090903100819/http://blogs.cgdev.org/globalhealth/2009/08/will-the-us-have-better-global-health-policies-but-get-worse-results.php#comments" title="Comment on Will the U.S. Have Better Global Health Policies but Get Worse Results?">1 Comment</a></p> </div> <div class="br"><br/></div> <div id="post-1226"> <h2> August 12, 2009 </h2> <h3><a href="https://web.archive.org/web/20090903100819/http://blogs.cgdev.org/globalhealth/2009/08/terminology-matters-the-dispute-between-india-and-eu-over-generic-drug-transshipments.php" rel="bookmark" title="Permanent Link to Terminology Matters: The Dispute between India and EU over Generic Drug Transshipments">Terminology Matters: The Dispute between India and EU over Generic Drug Transshipments</a></h3> <h4>By <a href="https://web.archive.org/web/20090903100819/http://blogs.cgdev.org/globalhealth/author/tbollyky/" title="Posts by Tom Bollyky">Tom Bollyky</a> </h4> <p><p>Over the last sixteen months, EU customs officials have impounded more than 20 shipments of pharmaceutical products manufactured by Indian companies. The EU maintains these seizures were intended to prevent trade in counterfeit medicines. India argues the EU is targeting developing country drug manufacturers and undermining access to lawful, safe, and low-cost generic drugs in developing country markets. Last week, India <a href="https://web.archive.org/web/20090903100819/http://online.wsj.com/article/SB124949598103308449.html">announced</a> plans to seek settlement of the dispute at the World Trade Organization (WTO).</p> <p>The legal merits of the EU’s actions and India’s potential WTO claims are interesting questions. The more important issue for global health, however, is that disputes such as this one may be undermining international efforts to combat the trade in counterfeit medicines and the environment  for legitimate generic products in developing countries.</p> <p><em> <a href="https://web.archive.org/web/20090903100819/http://blogs.cgdev.org/globalhealth/2009/08/terminology-matters-the-dispute-between-india-and-eu-over-generic-drug-transshipments.php#more-1226" class="more-link">More&#8230;</a></em></p> </p> <p class="posted"><a href="https://web.archive.org/web/20090903100819/http://blogs.cgdev.org/globalhealth/2009/08/terminology-matters-the-dispute-between-india-and-eu-over-generic-drug-transshipments.php#comments" title="Comment on Terminology Matters: The Dispute between India and EU over Generic Drug Transshipments">3 Comments</a></p> </div> <div class="br"><br/></div> <div> <div class="alignleft"><a href="https://web.archive.org/web/20090903100819/http://blogs.cgdev.org/globalhealth/page/2">&laquo; Previous Entries</a></div> <div class="alignright"></div> </div> <br/> </div> </div> <!-- end content div --> <div id="right"> <ul> <li id="text-377439231" class="widget widget_text"> <div class="textwidget"><p><a href="https://web.archive.org/web/20090903100819/http://blogs.cgdev.org/globalhealth/"><strong>Global Health Policy</strong></a> is a group blog discussing the issues facing the donor community on everything from HIV/AIDS financing to pharmaceutical R&amp;D to broader health systems concerns.
