User may not sell on or sublet the Service or any content contained in the Service on the Website and Mobile app.</p> <p>5.3. When using the Website and Mobile app, User must comply with all applicable laws. User may only use the Website and Mobile app and the Service for lawful purposes. User’s personal account and password</strong></p> <p>When User first purchases one or more of the available products listed on the Website and Mobile app, User is asked to set up a personal account and a password. Text and data mining policy < TDM-RESERVATION: 1></p> <p>8.6.1. The Company opposes all harvesting and text and data mining operations within the meaning of Article L. 122-5-3 of the French Intellectual Property Code.</p> <p>8.6.2. This objection covers the entire Website and Mobile app and the Content to which they give access.</p> <p>8.6.3. All harvesting and text and data mining operations targeting the Site and its Contents, including by automated data collection devices, therefore constitute acts of counterfeiting unless a specific, formally expressed agreement is obtained from the Company.</p> <p>8.6.4. As article R. 122-28 of the French Intellectual Property Code specifies that the opposition referred to in III of article L. 122-5-3 may be expressed by any means, including by recourse to the general terms of use of an Internet site or service, the absence of metadata associated with the Site, Site directories and Site Content has no bearing on the exercise of the right of opposition expressed by the present general terms of use.</p> <p>8.6.5. Personal data protection </strong></p> <p>9.1. The Company processes personal data in accordance with the Law Informatics and Freedoms and the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).</p> <p>9.2. The Company is responsible for the processing of personal data. The Company may ask User for certain personal data to provide its Services. This personal data includes User’s contact details including name, email, billing address, login and account information, password, payment or credit card information. The Company uses this personal data:<br class='manualbr' />– to provide User access to the digital learning platform and Services, <br class='manualbr' />– to communicate information about its Services, <br class='manualbr' />– to operate, improve and maintain its activity and the provision of its Services such as for accounting, audits or internal purposes, <br class='manualbr' />– to enhance User’s experience and to help the Company diagnose technical and service problems and administer digital learning platform.</p> <p>9.3 The Company shares User’s personal data with its mother company (Institut de droit de la Concurrence) and for the purposes outlined above and with service providers processing personal data on Company’s behalf, for example to process credit cards and payments. When using service providers, the Company enters into agreements that require them to implement appropriate technical and organisational measures to protect User’s personal data.</p> <p>The Company does not proceed to international transfer of personal data otherwise than with companies part of its group of companies such as Institut de Droit de la Concurrences (its mother company). Those companies may be located either in France, in the UK or in the US. They may have access to the personal data collected by the Company only to provide Users information on events organised by the Company or one of the companies part of its group.</p> <p>9.4. User has the right to request from the Company access to and rectification or erasure of personal data or restriction of processing concerning the data subject or to object to processing as well as the right to data portability by sending an email to edouard@concurrences.com. User may also lodge a complaint with the CNIL (National Commission on Informatics and Freedoms).</p> <p><strong>10. Applicable law and jurisdiction</strong></p> <p>10.1.
