À la différence du contrat, il n'existe pas de définition « officielle » du trust car il semble qu'aucune définition n'ait été acceptée comme complète et exacte. Le juriste anglais Underhill propose de voir le trust comme « une obligation équitable, liant une personne, appelée le trustee, en vue de gérer des biens sur lesquels elle exerce un contrôle, appelés les biens du trust, pour le bénéfice de personnes appelées bénéficiaires, dont il peut être l'une d'elle et de quiconque peut exiger l'exécution de l'obligation » Une définition classique du trust se trouve dans Halbury's laws of England : « lorsqu'une personne a dans son patrimoine des droits dont elle est titulaire ou qu'elle est tenue d'exercer dans l'intérêt ou pour le compte d'une ou plusieurs autres personnes ou encore pour l'accomplissement d'un ou plusieurs buts déterminés, elle est considérée avoir ces droits in trust dans l'intérêt du ou des bénéficiaires ou pour l'accomplissement du ou des buts dont il s'agit. Le titulaire de ces droits est un trustee..., lequel dispose de pouvoirs fiduciaires et est uni au bénéficiaire en vertu d'une relation fiduciaire ». (Nous soulignons) Nous remarquons que dans ces deux définitions, et cela est commun aux définitions des auteurs anglo-saxons, la notion de constituant disparaît totalement de l'institution car le trust, une fois constitué, échappe en principe au settlor. This article looks at Parliament debates over the religious or spiritual nature of Auroville, an international agroforestry ecovillage located near Pondicherry in Tamil Nadu (South India), established in 1968 by Mirra Alfassa, called “the Mother” (its founding charter’s author). Parliament eventually legislated over the spiritual, rather than religious, nature of the Auroville community (Minor, 1999). This article expands on Minor’s work to highlight the national and international importance “the Mother” had for a number of officials of the Indian State. Comment s’est articulée la relation entre l’État de droit et les hétérodoxies minoritaires en Inde ? Cet article propose de se pencher sur le cas d’étude de la communauté internationale d’Auroville, où l’État indien est intervenu législativement par une ordonnance provisoire, puis au moyen d’une loi en 1988 : l’Auroville Foundation Act. Auroville est située au sud est de l’Inde, au Tamil Nadu, près de Pondichéry. Un débat eut lieu entre députés pour déterminer si la nature d’Auroville était spirituelle ou religieuse et il fut statué qu’il s’agissait d’une communauté spirituelle non religieuse (Minor, 1999). Auroville, un écovillage agroforestier, a été fondé en 1968 par la Française Mirra Alfassa (1878–1973) – connue sous le nom de « la Mère » –, qui l’a défini par une charte. Régulièrement célébrées ou au contraire associées aux pires dérives, les communautés intentionnelles créent dans l'esprit collectif la possibilité de voir d'autres façons de vivre ensemble. Selon nous, les utopies sont avant tout une idée, un rêve qui cherche à se concrétiser même sans être parfait : car elles donnent à voir des « possibles » existants (Ricœur, 1997). A Auroville, la communauté cherche à se construire en gardant ses valeurs et en préservant la réalité du terrain tout en jonglant avec les critiques du monde extérieur. Finalement, le plus difficile n’est pas de penser les utopies mais de les ancrer dans le réel. A partir d’une étude longue de plus de six ans, dans une perspective monographique, nous souhaiterions questionner « l’effet miroir » que nous renvoient ces constructions humaines. Régulièrement célébrées ou au contraire associées aux pires dérives, les communautés intentionnelles créent dans l'esprit collectif la possibilité de voir d'autres façons de vivre ensemble. Selon nous, les utopies sont avant tout une idée, un rêve qui cherche à se concrétiser même sans être parfait : car elles donnent à voir des « possibles » existants (Ricœur, 1997). A Auroville, la communauté cherche à se construire en gardant ses valeurs et en préservant la réalité du terrain tout en jonglant avec les critiques du monde extérieur. Finalement, le plus difficile n’est pas de penser les utopies mais de les ancrer dans le réel. A partir d’une étude longue de plus de six ans, dans une perspective monographique, nous souhaiterions questionner « l’effet miroir » que nous renvoient ces constructions humaines.
