Las "teorías objetivas o funcionales" parten del concepto de "situación privada internacional". Toda "situación privada internacional" o, como señalan los profesores FERNÁNDEZ ROZAS y SÁNCHEZ LORENZO, cualquier relación jurídica que ponga en relación a distintos sistemas jurídicos nacionales, se caracteriza por la presencia de un "elemento de extranjería", esto es, de cualquier dato presente en la relación que no aparece conectado con la esfera nacional. Según esta teoría, el objeto de las normas de Derecho internacional Privado es el estudio del "tráfico jurídico externo", es decir, la existencia de relaciones privadas que superan las fronteras de un Estado, y que aparecen conectadas con otro Estado. Para cumplir el objetivo del presente trabajo se recurre al análisis de bibliografía especializada, en español, inglés y portugués, para realizar primero una conceptualización de la participación ciudadana juvenil, así como categorización y diferenciación de la misma, posteriormente se desarrolla el concepto de CID, más un análisis de su evolución histórico, categorización, poniendo especial énfasis en los donantes emergentes y la cooperación específica que ejercen estos donantes, ya que países latinoamericanos como México y Brasil se consideran emergentes. De igual manera se investigan ejercicios y casos realizados de CID en el tema específico de participación ciudadana, incluyendo el enfoque juvenil y la dimensión social. Aunado a lo anterior, se realiza una breve conceptualización de desarrollo, delimitando la concepción específica de desarrollo que presenta relevancia para la presente investigación. Esta vinculación entre cooperación y deberes integra desde hace varias décadas los debates del derecho internacional (DI) a través de la irrupción en el campo jurídico de la Cooperación Internacional (CI). Por CI entendemos el "conjunto de acciones que intentan coordinar políticas o aunar esfuerzos para alcanzar objetivos comunes en el plano internacional" (José Miguel Inzulza). Esta definición es aplicable a los campos más diversos: cooperación económica, cooperación militar, cooperación judicial, etc. Del inmenso espacio que abarcan las relaciones cooperativas entre los sujetos del DI vamos a concentrar nuestra mirada particularmente en la cooperación internacional al Desarrollo (CID), a la que podemos definir como el "conjunto de actuaciones, realizadas por actores públicos y privados, entre países de diferente nivel de renta, con el propósito de promover el progreso económico y social de los países del Sur, de modo que sea más equilibrado en relación con el Norte y resulte sostenible" (Gómez Galán y Sanahuja, 1999:17). No obstante, debemos ser cautos ante esta definición ya que como lo señala Alfonso Dubois (2002:125) "El concepto de cooperación para el desarrollo no tiene una definición única, ajustada y completa, válida para todo tiempo y lugar. La cooperación al desarrollo se ha ido cargando y descargando de contenidos a lo largo del tiempo, de acuerdo al pensamiento y los valores dominantes sobre el desarrollo y al sentido de corresponsabilidad de los países ricos con la situación de otros pueblos". La referencia anterior nos señala la necesidad de pensar la CID dentro de los marcos históricos y de distribución del poder mundial dentro de los cuales se ha movido.
