Music worden uitgegeven en beheerd door Apple Distribution International Ltd. (‘Apple’) en omvatten ook App Store & iTunes-cadeaucodes (gezamenlijk ‘Store-tegoed’) die – wanneer ze rechtstreeks bij de iTunes Store, App Store, Apple Books of Apple Music (‘Diensten’) worden gekocht – automatisch worden toegevoegd aan het account waaraan het tegoed verbonden is (‘Account’). Uw Accountsaldo is het saldo van al het Store-tegoed dat is ingewisseld op uw Account. Als u een Store-tegoed op uw Account hebt, worden aankopen bij de Diensten allereerst van uw Account afgeschreven. Eventueel niet-gebruikt saldo blijft op uw Account staan. Indien u onvoldoende saldo heeft voor een bepaalde aankoop, krijgt u het verzoek om via een andere betaalmethode te betalen. Als die andere betaalmethode onvoldoende is voor het resterende bedrag, wordt de transactie geannuleerd. </p><p><b>APPLE ID:</b> Voor het gebruiken van Store-tegoed of Contentcodes die in België zijn gekocht, moet u een Apple ID hebben en de algemene voorwaarden van de <a href="https://www.apple.com/legal/internet-services/itunes/benl/terms.html">Diensten</a> accepteren. Een Apple ID is het account dat u gebruikt om toegang te krijgen tot de Diensten. </p><p><b>Gebruik van uw Accountsaldo: </b>U kunt Store-tegoed op uw account zetten door fysieke of digitale cadeaubonnen in te wisselen voor Accountsaldo of door uw Accountsaldo op te waarderen via de Diensten. </p><p>U stemt ermee in dat u Store-tegoed niet zult gebruiken op een wijze die misleidend, bedrieglijk, oneerlijk of anderszins schadelijk is voor Apple of haar klanten. Als wij vermoeden dat een Store-tegoed frauduleus, onrechtmatig of anderszins in strijd met deze algemene voorwaarden is verkregen, is gebruikt of aan een Apple ID is toegevoegd, behouden wij ons het recht voor om, zonder kennisgeving aan u, Store-tegoed zonder restitutie nietig te verklaren of te deactiveren (met inbegrip van een deel van uw Accountsaldo), klantenaccounts op te schorten of te beëindigen, de mogelijkheid tot gebruik van de Diensten op te schorten of te beëindigen, bestellingen te annuleren of te beperken en alternatieve vormen van betaling te verlangen. <p>Als u de bij de Diensten opgegeven betaalmethode gebruikt om uw Accountsaldo op te waarderen, dient vóór afschrijving via die opgegeven betaalmethode het bedrag van uw aankoop- of bijschrijftransactie te worden geautoriseerd.<p><b>Beperkingen: </b>Store-tegoed is niet inwisselbaar voor contant geld en kan niet worden geretourneerd voor een restitutie in contant geld (tenzij dit wettelijk verplicht is), omgeruild, doorverkocht, gebruikt om Cadeaus of Cadeaubonnen te kopen of gebruikt om aankopen te doen in de Apple Online Store of Apple Retail Stores. Cadeaubonnen en Contentcodes kunnen alleen worden gebruikt om content te kopen bij de <a href="https://www.apple.com/legal/internet-services/itunes/benl/terms.html">Diensten</a>. Niet-gebruikte tegoeden zijn niet overdraagbaar. Apple kan u informatie verstrekken over de inwisselstatus van Store-tegoed dat u heeft gekocht. </p><p>Store-tegoed en Contentcodes die in België zijn gekocht, kunnen alleen worden ingewisseld op een Account in België of de gebieden en bezittingen van België. </p><p>Als u besluit uw Apple ID op te heffen, dient u uw Accountsaldo te besteden voordat u het account afsluit. </p><p><b>Risico van verlies: </b>Apple is niet verantwoordelijk voor verloren of gestolen Store-tegoed of Contentcodes. Het risico van verlies en de eigendom van Store-tegoed en Contentcodes gaan over op de koper, in Ierland, bij elektronische verzending aan de ontvanger. </p><p>Apple <a href="https://www.apple.com/legal/internet-services/itunes/benl/terms.html">behoudt zich het recht voor</a> een account te sluiten en een andere vorm van betaling te verlangen wanneer een Store-tegoed of Contentcode frauduleus is verkregen of wordt gebruikt bij de Dienst.</p><p><b>Beperking/uitsluiting van aansprakelijkheid: </b>APPLE EN HAAR LICENTIENEMERS, GELIEERDE ONDERNEMINGEN EN LICENTIEGEVERS GEVEN GEEN EXPLICIETE OF IMPLICIETE GARANTIES MET BETREKKING TOT STORE-TEGOED, CONTENTCODES OF DE ITUNES STORE, APP STORE, APPLE MUSIC OF APPLE BOOKS, MET INBEGRIP VAN MAAR NIET BEPERKT TOT ENIGE EXPLICIETE OF IMPLICIETE GARANTIE VAN VERKOOPBAARHEID OF GESCHIKTHEID VOOR EEN BEPAALD DOEL. INGEVAL EEN STORE-TEGOED OF CONTENTCODE NIET WERKT, IS UW ENIGE RECHTSMIDDEL EN ONZE ENIGE AANSPRAKELIJKHEID BEPERKT TOT HET VERVANGEN VAN UW STORE-TEGOED OF CONTENTCODE. U VERKLAART DAT U GEEN SCHADE ZULT VORDEREN VAN OF VERHALEN OP APPLE, HAAR DIRECTEUREN, FUNCTIONARISSEN, WERKNEMERS, GELIEERDE ONDERNEMINGEN, AGENTEN, OPDRACHTNEMERS EN LICENTIEGEVERS DIE HET GEVOLG IS VAN EEN BESLUIT VAN APPLE OM INFORMATIE OF CONTENT TE VERWIJDEREN OF NIET TE BEWERKEN, U TE WAARSCHUWEN, UW TOEGANG TOT DE DIENSTEN OP TE SCHORTEN OF TE BEËINDIGEN, OF EEN ANDERE MAATREGEL TE NEMEN GEDURENDE HET ONDERZOEK NAAR EEN VERMOEDELIJKE SCHENDING, OF DIE HET GEVOLG IS VAN APPLE'S CONCLUSIE DAT ZICH EEN SCHENDING VAN DEZE OVEREENKOMST HEEFT VOORGEDAAN. DEZE AFSTANDS- EN VRIJWARINGSCLAUSULE IS VAN TOEPASSING OP ALLE IN DEZE OVEREENKOMST BESCHREVEN OF BEDOELDE SCHENDINGEN.</p><p><b>Toepasselijk recht: </b>Behalve voor zover uitdrukkelijk in de volgende alinea is bepaald, is op deze Overeenkomst en de relatie tussen u en Apple het recht van de Amerikaanse staat Californië van toepassing, met uitzondering van de daarin vervatte verwijzingsregels van internationaal privaatrecht (conflict of law provisions). U en Apple komen overeen zich voor het oplossen van geschillen of vorderingen naar aanleiding van deze Overeenkomst te onderwerpen aan de enige en exclusieve bevoegdheid van de rechter in de county Santa Clara. Als u (a) geen Amerikaans staatsburger bent; (b) niet in de VS woonachtig bent; (c) de Dienst niet vanuit de VS gebruikt en (d) een staatsburger van een van de onderstaande landen bent, stemt u er hierbij mee in dat op geschillen of vorderingen voortvloeiend uit deze Overeenkomst het hierna te noemen recht van toepassing is, met uitsluiting van eventuele verwijzingsregels van internationaal privaatrecht, en onderwerpt u zich hierbij onherroepelijk aan de niet-exclusieve bevoegdheid van de rechter in de/het hierna te noemen staat, provincie of land waarvan het recht van toepassing
