To assess the existing practice of formation \u0026amp;amp; contractual process of Users Committees while implementing construction projects at Khairahani Municipality Chitwan., Nepal. Design/Methodology/Approach: The study was solely the project management practice of the Municipality implementing through UCs using Checklist Survey for projects with cost more than 10 laks. Data of the 33-sample site (different sectors of construction) will be collected and analyzed to obtain the significance. The information collected from the UCs members through the questionnaire and the consultations. The data were also collected from the Engineers, Sub Engineers, Planning officers, Assistant planning officer, Account Officer, Accountant, and elected representatives employed through questionnaire. All the collected data were analyzed quantitatively and qualitatively using bars, graphs \u0026amp;amp; diagrams and comparison with existing laws. Findings/Result: The UCs in the projects of Municipality was formed by the general mass meeting of local beneficiaries without political interferences or biases. For the construction projects implementation through UCs, its formation was through the participatory approach but it was not strictly followed the prevailing acts, rules, guidelines and directives to local bodies for the composition of UCs. The supervision and monitoring mechanism exists but it was not functioning as well. The projects after the work completion had been examined and cleared within the time. The ownership of the projects, O \u0026amp;amp; M fund and handover of the completed projects was not clearly defined. There were very few projects implemented through UCs that have adverse environmental impact, though the environmental impact consideration should be taken. From the study it is found that both the approaches can be suitable depending on the specific conditions and requirements. Each one of them has its own merits and demerits which do not enact in all situation of rural construction work. Originality/Value: The existing practice of formation and contractual process complies with existing laws, bylaws rules, regulations, and guidelines illustrate law binding The information collected from the UCs members through the questionnaire and the consultations. The data were also collected from the Engineers, Sub Engineers, Planning officers, Assistant planning officer, Account Officer, Accountant, and elected representatives employed through questionnaire. All the collected data were analyzed quantitatively and qualitatively using bars, graphs \u0026 diagrams and comparison with existing laws. Findings/Result: The UCs in the projects of Municipality was formed by the general mass meeting of local beneficiaries without political interferences or biases. For the construction projects implementation through UCs, its formation was through the participatory approach but it was not strictly followed the prevailing acts, rules, guidelines and directives to local bodies for the composition of UCs. The supervision and monitoring mechanism exists but it was not functioning as well. The projects after the work completion had been examined and cleared within the time. The ownership of the projects, O \u0026 M fund and handover of the completed projects was not clearly defined. There were very few projects implemented through UCs that have adverse environmental impact, though the environmental impact consideration should be taken. From the study it is found that both the approaches can be suitable depending on the specific conditions and requirements. Each one of them has its own merits and demerits which do not enact in all situation of rural construction work. The supervision and monitoring mechanism exists but it was not functioning as well. The projects after the work completion had been examined and cleared within the time. The ownership of the projects, O & M fund and handover of the completed projects was not clearly defined. There were very few projects implemented through UCs that have adverse environmental impact, though the environmental impact consideration should be taken. From the study it is found that both the approaches can be suitable depending on the specific conditions and requirements. Each one of them has its own merits and demerits which do not enact in all situation of rural construction work. Findings/Result: Need of empowerment & awareness to the beneficiaries too for their commitment by contributing to the construction projects and also providing orientation training to develop technical and managerial skills to UCs. A mandatory system of feasibility study of the projects for the financing of beneficiaries' contributions is essential. The work schedule or work plan should be attached to the agreement. From the many other interrelated problems, use of inappropriate and inequitable contract conditions is one of the problems of the industry for lack of any appreciable development. The objective of this study is to identify drawbacks and shortcomings of the local construction conditions of contract adopted for public works in Ethiopia and to find out provisions that have negative implication for the development of the sector. The study focuses on provisions related to finance, risk allocation, claim substantiation & dispute settlement procedures, and the practice of contract administration. Questionnaire and interview survey together with desk study provide the main strategy for data collection methods. Samples for the study have been randomly selected from public employers, domestic consultants, and domestic contractors who are actively participating on public construction works. In this thesis, a descriptive statistical method has been used for the analysis of the data that provides a general overview of the results in that some kind of interpretations and discussions are made on the results. The study has determined the potential contract provisions that hinder the development of the sector and the findings of the study reveal that: the financial provisions adopted for public works are not suitable and need much further improvement; the risk allocation between public employers and domestic contractors need to address price escalation and unforeseeable shortage of materials fairly; the claim substantiation & dispute settlement procedure should adopt modern methods and practices; and contract administration practices & attitudes should be improved. Five problems of payment & cost aspect consists of auditing of records, consultant's remuneration in delay contract, foreign currency, late payment, and payment in case of construction contract suspension or termination. Three problems related to technical provisions & general management are impartiality of the consultant, obligations of the employer, and subcontracting & assignment. In addition, three problems related to suspension & termination are liability after termination, prior notice requirement, and reasons to terminate agreement. Procurement and supply chain transformation to a great extent have contribute to management of public financed projects through, strategic sourcing, tenderers collaborations management, budgets management, contract managements, staff’s competences lead to effective management of public financed projects. Despite of effective management of public funds in implantation of various projects, management of public financed project face various challenges like natural disaster, cost overrun, technological changes and political opposition. Resolution for challenges facing public financed projects, included investment on the strategic projects, use of relevant experts in the management of projects, training and seminar to public servants in management of public financed projects. In conclusion efficiency management of public financed projects will results to achievement of value for money in public projects. Accelerating the construction of city facilities, such as buildings, requires comprehensive planning and implementation through a well- coordinated implementation between Contractors and Supervisors. The project to construct a city facility in the form of a building is a relatively complex process because of the many variables and components of work that must be completed properly in accordance with technical and administrative specifications regulated in central and regional regulations. Project success is not only in the mastery of project management but is also influenced by humans as controllers in project management. Therefore, PMU and stakeholders procedure manual are needed, so that the identification of tasks and responsibilities in the planning, implementation and supervision phases of the project can be an important document as a guide in managing the project towards project success. The purpose of this study is to determine the tasks and flow of PMU activities with stakeholders which is explained through the procedure manual. The type of research used is expose facto. Data were obtained and collected using FGDs and analyzed using a qualitative approach. In the PMU procedure manual with stakeholders in the implementation and supervision phases, it can be concluded that the tasks and responsibilities of the Contractor and Supervisor are still more dominant. The PMU carries out assistance in an integrated manner in its implementation and supervision phases so that in this phase it follows the methods and rules that apply and are specified in the project documents.
