<div>　　10月16日上午9:30，市政府新闻办举行新闻发布会，市司法局二级调研员邹德生，市水务局党组成员、副局长、新闻发言人于泉贵介绍《威海市污水排水管理办法》有关情况。<br /> </div><div>　　<strong>《威海市污水排水管理办法》已于2024年9月30日市人民政府第40次常务会议审议通过，将于2024年12月1日起施行。</strong>《办法》共二十七条，按照“小快灵”的思路，针对我市污水排水管理中存在的问题，着重补充完善制度上的空白点、薄弱点和模糊点。对上位法已有明确规定的内容，除了进行必要的强调外，不再作重复规定。主要内容如下：<br /> </div><div>　　<strong>明确了污水排水的监管责任</strong><br /> </div><div>　　规定市、区(县级市)人民政府应当加强对污水排水与处理工作的领导，协调、解决污水排水与处理工作中的重大事项，保障污水排水与处理所需资金。城镇污水排水主管部门负责辖区内城镇污水排水与处理的监督管理工作，加强污水排水与处理管理信息系统建设，提升信息化、智慧化水平。自然资源、生态环境、住房城乡建设等部门按照各自职责，做好相关工作。镇人民政府、街道办事处协助相关部门做好辖区内城镇污水排水与处理管理工作。<br /> </div><div>　<strong>　明确了污水排水的行为规范</strong><br /> </div><div>　　规定城镇污水排水主管部门应当会同有关部门划定城镇污水排水设施覆盖范围，并向社会公布。城镇污水排水设施覆盖范围内排放污水的单位和个人应当按照规定将污水排入城镇污水排水设施，不得排入雨水排水设施、直排自然环境或者排入堵塞、破损、渗漏的排水设施。排水户向市政污水排水设施排放污水的，应当取得污水排入排水管网许可证，建设相应的沉砂池、隔油池等污水预处理设施，保障设施安全运行，污水达标排放。<br /> </div><div>　<strong>　明确了污水排水设施的管护责任主体</strong><br /> </div><div>　　对不同类别的污水排水设施规定了不同的维护责任主体，规定市政排水设施由建设单位或维护运营单位负责；自建污水排水设施由产权人(单位)或其委托的单位负责；产权不明或者难以确定责任主体的，由属地政府指定维护单位负责。<br /> </div><div>　<strong>　明确了污水排水设施的保护措施</strong><br /> </div><div>　　一是对损毁、盗窃城镇污水排水设施、倾倒废弃物、擅自加压排水等8项危及城镇污水排水设施安全的行为作了禁止性规定；二是划定了市政污水排水设施保护范围，规定在保护范围内从事爆破、钻探、打桩、顶进、挖掘、取土等可能影响排水设施安全活动的，应当与设施维护运营单位等共同制定设施保护方案，采取相应的安全防护措施。同时，还对从事危及城镇污水排水设施安全活动的行为规定了法律责任。<br /> </div><div>　　<strong>明确了市政排水设施维护运营单位的维护责任</strong><br /> </div><div>　　规定市政污水排水设施维护运营单位应当履行制定实施设施运行管理制度和安全管理制度、落实维修计划、开展日常巡查检查、不得擅自停止设施运行或减少进水量、定期清疏保持管道通畅、及时抢修排水设施故障、劝阻违规排水行为并向主管部门报告、指导排水户接驳排水管网等日常管理责任；并对市政污水排水设施的维护或者检修、停运及应急处理等行为规定了报告、通告等程序。<br /> </div><div>　<strong>　《办法》作为我市新出台的市政府规章，为污水排水管理提供了法律依据，《办法》制定出台的背景和过程是怎样的？<br /> </strong></div><div>　　“精致城市·幸福威海”建设新局面的开展以优良的水生态环境质量为重要支撑，污水排水与处理工作直接关系到水生态环境质量安全。出台《威海市污水排水管理办法》，建立科学合理的污水排水管理制度，可以进一步保证污水妥善收集处理，设施稳定运行，也是防治城市水环境污染的重要手段。<br /> </div><div>　　近年来，我市组织开展了城市污水处理提质增效、城市黑臭水体整治、“两个清零、一个提标”等工作，实施了新改扩建城市污水处理厂系列工程，配套出台了城市排水许可管理文件，积极推进污水排水管理向高质量精细化方向发展。但也面临着设施安全保护、维护管理等新课题，急需通过出台地方政府规章进行引导规范，巩固工作成果。为了加强污水排水管理，我市将《威海市污水排水管理办法》列入了2023年政府规章调研项目、2024年政府规章完成项目。市水务局成立局主要负责人为组长、分管负责人为副组长的领导小组以及相关科室负责人、法律顾问、公职律师等专业人员参与的工作小组，为《办法》调研、起草等工作开展奠定组织基础。为确保《办法》契合地方实际，组织了各区市排水主管部门、市水务集团并邀请法律专家等开展座谈调研，并对企业排水情况进行现场调研，掌握各相关主体对于排水管理办法的需求。同时，为提升《办法》的全面性，先后赴湖北武汉、广东深圳、福建厦门等地市进行实地调研，充分了解各地市城市污水排水法规规章的起草情况、管理体制及日常管理执法等工作情况，学习借鉴了先进经验。市司法局对水务局起草的《办法(草案送审稿)》依法进行了审查，并听取了各区市政府、市政府有关部门、市政府法律顾问、市行政立法联系点和社会公众的意见，经多次修改完善形成草案，并提交市政府常务会议研究通过。<br /> </div><div>　　《威海市污水排水管理办法》于2024年10月11日以市政府令第81号公布，将于2024年12月1日起施行。《办法》以保障污水排水与污水处理设施安全运行、达标排放，推进城市水环境质量持续改善，增强城市韧性为着眼点和立足点，围绕污水排水管理现状问题和实际需求进行制度构建，为污水排水管理提供了法治保障，将对污水排水管理高质量、精细化发展起到良好的推动和支撑作用。<br /> </div><div>　　<strong>污水排水设施是重要的基础设施，《办法》对保护污水排水设施作出了哪些规定？</strong><br /> </div><div>　　污水排水设施能否安全正常运行关系到水环境质量安全和城市韧性，影响着人民群众的生活质量和环境质量。关于对污水排水设施的保护，《办法》主要从以下方面进行了规范：<br /> </div><div>　　明确了八类禁止实施的危及城镇污水排水设施安全的行为。包括禁止损毁、盗窃；禁止穿凿、堵塞、填埋；禁止向设施排放或者倾倒剧毒、易燃易爆、腐蚀性废液和废渣；禁止向设施倾倒废弃物；禁止建设占压设施的建筑物、构筑物或者其他设施；禁止擅自拆卸、移动，禁止在污水排水管网内穿管、穿线；禁止向设施加压排水；以及禁止实施法律、法规、规章规定的其他危及设施安全的行为。并对上述行为规定了法律责任，规定由城镇污水排水主管部门责令停止违法行为，限期恢复原状或者采取其他补救措施，给予警告；逾期不采取补救措施或者造成严重后果的，对单位处10万元以上30万元以下罚款，对个人处2万元以上10万元以下罚款；造成损失的，依法承担赔偿责任；构成犯罪的，依法追究刑事责任。<br /> </div><div>　　明确了市政污水排水设施保护范围和保护要求。明确保护范围的划定，要按照排水重力流管道外缘两侧各3米、压力流管道外缘两侧各5米；排水检查井边缘以外3米的规定进行。规定在保护范围内，有关单位从事爆破、钻探、打桩、顶进、挖掘、取土等可能影响排水设施安全的活动的，应当与设施维护运营单位等共同制定设施保护方案，并采取相应安全防护措施。设施维护运营单位应当加强保护范围内的安全检查，发现施工活动等行为危及或者可能危及排水设施安全的，应当立即制止并及时报告城镇污水排水主管部门。<br /> </div><div>　　<strong>市政污水排水设施竣工验收合格后，由维护运营单位负责管理，维护运营单位在具体工作中有哪些义务？</strong><br /> </div><div>　　《办法》对市政污水排水设施维护运营单位的确定及其义务进行了明确。规定市政污水排水设施竣工验收合格后，由城镇污水排水主管部门通过招标投标、委托等方式，确定符合条件的设施维护运营单位负责管理，并签订维护运营合同，明确双方权利义务。关于市政污水排水设施维护运营单位的义务，《办法》明确了八大义务，包括制定设施运行管理、安全管理制度，并组织实施；制定维修计划，进行日常巡查检查、维修养护，及时消除运行隐患；不得擅自停止设施运行或者减少进水量；定期清疏，保持管道畅通；发生管道堵塞、污水外溢、泵站故障、管道破裂的，应当及时抢修；发现违法行为应当及时劝阻并向城镇污水排水主管部门报告；指导排水户接驳排水管网、办理排水许可证、规范排水行为等；以及依法或者按照约定应当履行的其他职责。此外，因设施维护或者检修可能对污水排水造成影响的，《办法》明确维护运营单位应当提前24小时通知相关排水户；可能对污水排水造成严重影响的，应当提前24小时向主管部门报告，采取应急处理措施，并向社会通告。<br /> </div><div>　<strong>　接下来我市计划从哪些方面抓好《办法》的贯彻落实，保障城市污水排水管理的进一步提升？</strong><br /> </div><div>　　我市目前共有城市生活污水处理厂8座，污水处理能力达到46.5万立方米/日，配套建设市政污水管网2339.86公里。<br /> </div><div>　　《办法》的出台为我市污水排水管理迈上新台阶提供了重要的法治保障。为确保《办法》的要求落到实处，下一步，将重点做好三方面工作：<br /> </div><div>　　加强政策宣传指导。持续做好后续的政策解读，指导各区市污水排水行业主管部门和排水企业及时完善管理制度，制定工作计划，认真抓好贯彻落实。<br /> </div><div>　　推进基础设施建设。结合城市发展和污水排水量的增长趋势，依据相关规划，坚持科学谋划、适度超前，推进污水处理厂提标改造及新建扩建等项目，持续开展污水管网排查修复，不断提升污水收集处理能力，为城市经济发展和居民生活保驾护航。<br /> </div><div>　　强化部门协同治理。以本次《办法》出台为契机，积极与生态环境等相关部门对接沟通，落实《办法》规定，严格查处违规排水、未按要求运营维护等违法行为，保障各类污水排水与处理设施安全稳定运行。不断完善信息共享机制，形成齐抓共管的良好局面，协同解决提升污水排水与处理管理水平的制约要素，确保《办法》落实到位。<br
